1. Avrahom asks:

Shalom Aleichem Chevra HaKedosha of the Kollel

If Reuvein is chasing Shimon, and Shimon starts throwing Reuven's dishes, he doesn't have to pay for the dishes.

If Reuvein can stop Shimon with Levi's dishes, granted that Reuvein (I assume with urgency threw dishes on hand to save himself). The argument that Levi should be compensated...

1. If Levi was there, Lo Sa'amod Al Dam Rei'echa

2. Even not there why does Shimon have to pay? Reuvein is the only reason he threw Levi's dishes! Let the Rodeif pay for dishes!

Some yid goes meshugah, the Nirdaf has time to assess who's dishes he is throwing!

I need your Bikius...I'm Oker Harim Fashtei Nisht

Avrahom , United States

2. The Kollel replies:

Dear Avrahom,

The Rodef never pays for anything. His "death penalty" releases him from all monetary liability.

You are correct that Levi must save Reuven and he even must spend money to save him. But Reuven must pay back to Levi because he "used" money of others and that should be paid back. See Shulchan Aruch, Choshen Mishpat 426:1, and S'ma and Shach there (this applies whether Levi spent his own money or whether Reuven took Levi's money to save himself).

All the best,

3. Avraham asks:

The cases the Rodeif are patur, Kum lei bdrabah minei.

Reuvein wants to kill Shimo Badly. During the Chase Shimon breaks items.

I understand that Shimon is chayav to the owners. What I don't understand is after the fact, though Reuvein might be a bar katalah...the damages by Shimon resulted from the chase.

The chase is over...the monetary obligations of Shimon exist because Reuvein was chasing him. Reuvein was possibly a grama of the Nezek caused by Shimon.

Shimon should have a claim on him

4. The Kollel replies:

Dear Avrahom,

During the time of the chase, the Rodef has on him the death penalty and that releases him from monetary obligations which happen during that time. Afterwards there is no new obligation and the Petur remains. For example, if a person shoots an arrow which kills someone and tears his shirt, he is Patur on the shirt forever.

All the best,

Reuven Weiner
