DAF DISCUSSIONS - YOMA 67

Moses asked:

The Gemara discusses whether the Sa'ir ha'Mishtale'ach is mutar b'hanaah. Question- Why don't we use "D'chuyaso L'tzuk Zehu Shchitoso" to say that it is even Mutar B'achila? Just like we say it has a halacha of shchita regarding Oso V'es Bno!

Moshe

The Kollel replies:

The Sfas Emes asks your question, and answers that this is not considered "Zevichah" on which the Pasuk states "v'Zavachta...v'Achalta" -- "and you will slaughter...and you will eat" (Devarim 12:21). [Oso v'Es Bno is an Isur against "Shechitah."] By Melikah, the Gemara in Zevachim (69a) indeed requires a special Pasuk to tell us that the Kohanim may eat the meat, and we have no such Pasuk by the Se'ir ha'Mishtalei'ach. This is the basic reason given by other Acharonim as well (see Minchas Chinuch Mitzvah 185:10 who seems to remain unclear whether or not the meat is permitted to eat).

All the best,

I saw last night that the Minchas Chinuch in Mitzvah of Avodas Yom Hakipurim, discusses this issue. He says that eventhough we say "D'chuyaso L'tzuk Zehu Shchitoso" we need a real shchita to be mattir B'achila from the posuk "V'zavachta V'achalta".
