DAF DISCUSSIONS - GITIN 65

Mordechai Goldstein asked:

1) What is the bottom line? Is holech k'zchi or not? What do we hold Bzman Hazeh?

2) I dont understand why Gittin 65A if he specifies only receive the get in Makom Ploni, that Tnai takes effect. A get is a shtar. So he's making tnaim based on what? IT's a get. She got the get. Whats the problem?

The Kollel replies:

1) The Shulchan Aruch (CM 125:5) codifies explicitly that Holech is k'Zchi regarding a loan or deposit, but not a present.

2) In order for the Get to take effect, the husband must want to give the Get. He therefore may establish conditions upon which are dependent his will to give the Get. It is therefore possible that when he establishes a place to give the Get, he is essentially saying, "I only consent to give the Get if it is given in this fashion." The mere giving of the Get without his consent is totally ineffective.

All the best,

Yaakov Montrose
