DAF DISCUSSIONS - BAVA BASRA 61

1. Zak Silverblatt asks:

Hi. I have two questions on the quiz q&a from daf 61 and daf 63.

Daf 61 Question 3. I believe that the answer to this question is 'True' because the yetzia and the house have the same use, the yetzia must be 4 amos to not be included. I don't think that this is a machlokes.

>>3. The Yetzi'a is excluded from the sale only if it is at least four Amos.

a) True.

b) False.

c) It depends on the local custom.

d) Machlokes A&B.

e) Machlokes A&C.<<

Daf 63 question 6. I think the answer to this question should be 'A'. The gemara concludes that the 'depth to the sky' is never needed, and i don't think it's the correct answer.

>>6. One sells a house and and wants to include the pit and cistern. What does he write in the contract?

a) "The depth and height."

b) "From the depth below the earth to the sky."

c) He must write "pit."

d) A or B.

e) Machlokes all of the above.<<

Please help me understand where i am mistaken.

Thank you very much.

2. The Kollel replies:

Dear Zak,

On Daf 61, the quiz learns that Ravina who asks on Mar Zutra personally holds different than Mar Zutra and says that Yetzi'a is not included, even smaller than four Amos. (It is quite possible to learn that Ravina gives in to Mar Zutra after his answer, and then you could answer True.)

On Daf 63, "a" is not a good answer since "the depth" is not enough to include a pit. You must have the longer expression "mi'Tehom...." The Rashbam explains that the added words "to the sky" are needed to complete the expression. Tosfos explains more. Since "a" is not enough, we need "b".

All the best,
