DAF DISCUSSIONS - SHABBOS 43

Aaron Rothstein asks:

Regarding Muktze such as eitzim v'avanim, would the fact that someone is machshiv such items for a particular purpose (even if others do not) be relevant in transforming from davar muktze to a davar sheino muktze?

Thank you,

Aaron Rothstein

The Kollel replies:

I presume this is a halachic query. The Shulchan Aruch (Orach Chayim 308:22) states that items which are usually used for a permissible act can be designated by an individual for one Shabbos, whereas if they are not usually used for permissible acts they need to be designated by a person forever in order to permit their use on Shabbos.

Since we do not commonly use pieces of wood or stones in our houses, they would require Yichud (designation) forever, meaning that he thinks in his mind before Shabbos to use them for a specific purpose and they are set aside for that purpose. However, if he did an act which proves he intends to use them for that purpose, like putting a stone in a door to hold it open, he can move the stone even if he designated it for one Shabbos alone.
