DAF DISCUSSIONS - BAVA METZIA 32

Aryeh Rosen asked:

The gemara brings down a case of a kohen that cannot return an aveida due to his restriction of his "kohen status" since he cannot return the object his chiyuv should be finished. Once he himself cannot return the object does he now have the obligation to inform someone else to get the object to the rightful owner or not? (is this a cheftza/gavra shaalah; is the chiyuv of hashavas aveida a responsibility of the person to return the object of is the chiyuv to do what ever he can to get the object back to the owner and therefore have to tell someone could enter the cemetery to retrieve the object and return it)

Aryeh Rosen, Baltimore MD

The Kollel replies:

Dear Aryeh,

The Cohen has no obligation at all to tell others. (There is no mention in Shulchan Aruch at all.) The Gemara only discusses if the Zaken wants to do Lifnim m'Shuras ha'Din, whether he should do it himself or hire someone else. See Choshen Mishpat 263:1 and 272:3.

All the best,
