DAF DISCUSSIONS - KIDUSHIN 23

Rabbi Ian Bailey asked:

Can a Jewish slave marry a Jewish woman as a new wife while he is a slave?

Rabbi Ian Bailey, Sacramento, CA, USA

The Kollel replies:

Dear Rabbi Bailey,

A Jewish slave remains a normal Jew besides his obligations as a slave. Therefore marrying a Jewish woman is within his rights. See the Rambam Hilchos Avadim 3:1 that proves this point: "Both the wife ... that he had when he was sold and also a wife ... that he married after being sold [are supported by the Adon (see Kidushin22a)] -- if he married her with the Adon's permission. But if he married her without permission, the Adon doesn't need to support her" (the marriage doesn't require permission, only concerning the support).

All the best,
