Daniel asks:

On daf 22 a the Gemara brings a "Ta Shema- Shataf Nahar" on it the gemara Rava says "Ha Stama Lo" meaning that in a case where the owner has not given "Yeush" (even if they eventually will) you can't keep the avadah.

Why didn't the gemarah ask "Ha Stama Lo" on the "Ta Shema" on the previous Daf "Ha Motzei Maot?" There the Briasa says one who finds money in the Bas Midrash, Bas Keneset or any place the many go through can keep it "because the owner gave yeush."

The Kollel replies:

In the case on Daf 22a, the owner saw his article being swept away.

Consequently, there is no reason to assume that he was automatically

Meya'esh, as he may well have had in mind to go and retrieve it when it lands. When

the Tana therefore says that he was meyaesh, he must mean that we

heard him say so; hence the inference ha Stama, Lo.

In the case on the previous Amud however, where somebody finds money,

the owner did not know that he lost it (otherwise he would have

picked it up). Consequently, when the Tana says that the owner was Meya'esh,

he presumably means that we assume that he was, and there is nothing to infer.
