If you need all 3 simanim to be a shoteh. But if you only have 1 then we say maybe this, and, maybe that. Then why aren't you a sofek shoteh in these circumstances. Rashi seems to say that you are not a shoteh whatsoever, not leinyan Kinyan, or mekach, unless you have all 3 simanim??

Dear Avrumi,

The Turei Even discusses your question. One could answer that Chazaka sets that the person was known to be a Pekeach but that wouldn't be true if he is not known to us.

The Turei Even answers that the rule of Rov (majority) will let us assume he is normal, even l'Chumra.
