NEDARIM 78 (18 Teves 5783) - Two weeks of study material have been dedicated by Mrs. Estanne Abraham Fawer to honor the Yahrzeit of her father, Rav Mordechai ben Eliezer Zvi (Rabbi Morton Weiner) Z'L, who passed away on 18 Teves 5760. May the merit of supporting and advancing Dafyomi study -- which was so important to him -- during the weeks of his Yahrzeit serve as an Iluy for his Neshamah.

Observation: The Yerushalmi connotes that also a Chacham can say 'there is no Neder here', [or] 'there is no Shevu'ah here.'

Citation (Yerushalmi): If a husband said in the expression of a Chacham, or a Chacham said in the expression of a husband, his words have no effect. Rather, he says like his law, and he says like his law;

הבעל אומר מופר ליך והזקן אומר אין כאן נדר אין כאן שבועה

Citation (cont.): The husband says "it is Mufar to you", and the Chacham says 'there is no Neder here', 'there is no Shevu'ah here.'

Consequence: According to this, it seems to me that the expression of Mufar applies to from now and onwards, and the expression of Mutar refers to something that was permitted from its beginning. (I.e. there is no problem if they use a common expression. However, the usual expression of a husband implies from now and onwards, so it does not work for a Chacham, and the usual expression of a Chacham implies Heter retroactively, so it does not work for a husband. - PF)

Gemara: It says here "Zeh ha'Davar."

Gemara: Just like Shechutei Chutz, Aharon, his sons and all of Yisrael.

דהא כתיב בריש ההיא פרשה דבר אל אהרן ואל בניו ואל כל בני ישראל שכולן שוין בה

Explanation: It says at the beginning of that Parshah "Daber El Aharon v'El Banav v'El Kol Bnei Yisrael" - all of them are the same in it;

אף בפרשת נדרים אהרן ובניו וכל ישראל דכולן כשרין להתיר את הנדר.

Also Parshas Nedarim, Aharon, his sons and all of Yisrael are qualified to permit a vow.

Explanation: Since the Gezeirah Shavah includes Hedyotos, and Roshei ha'Matos excludes them, you are forced to fulfill both of them. Roshei ha'Matos refers to a lone expert, and commoners annul when there are three.

וכי תימא תלתא מנא לך

Question: What is the source for three?

כיון דמפקת ליה מחד אוקמיה אתלתא כעין ב"ד.

Answer: Since we preclude one (only a Chacham may permit alone), we establish it to refer to three, like Beis Din (which has at least three judges).

Gemara: To say that there is She'elah in Hekdesh.

שאם הקדיש בהמה ושחטה בחוץ ואח"כ נשאל עליה פטור

Consequence: If one was Makdish an animal and slaughtered it outside [the Mikdash] and afterwards asked about it (permitted his Hekdesh), he is exempt.

דכיון שיש שאלה בהקדש כאילו לא הקדישה מעולם דמי דחכם עוקר הנדר מעיקרו.

Explanation: Since there is She'elah in Hekdesh, it is as if he was never Makdish it, for a Chacham uproots the vow from the beginning.

Gemara: According to Beis Shamai, who say that there is no She'elah in Hekdesh.

בריש פרק ב"ש (נזיר דף ל:) דהקדש טעות הקדש וכיון שכן ודאי לב"ש אין שאלה בהקדש דשאלה לא מהני אלא משום דהוה ליה כנדר טעות.

Explanation: In Nazir (30b), for mistaken Hekdesh is Hekdesh. Therefore, surely Beis Shamai hold that there is no She'elah in Hekdesh, for She'elah helps only because [it shows that] it was like a mistaken vow.

Explanation: Beis Din need not be Mekadesh Sunday in order to make the seventh day Shabbos.

This is the meaning of what it taught "Mo'adei Hash-m were said regarding Kedushas Beis Din", like I explained. Shabbos Bereishis was not said with them, for that matter of Kidush.

והיינו דקאמר בן עזאי מועדי ה' נאמרו לענין שצריך מומחין לקדש את החדש מפני המועדות אבל פרשת נדרים לא נאמרה עמהן לאותו ענין

Support: This is why Ben Azai said "Mo'adei Hash-m were said" regarding the need for expert [judges] to be Mekadesh the month, due to the Mo'adim. Parshas Nedarim was not said with them for this matter;

Since it says "Asher Tikre'u Osam" - we read this 'Atem', and it was said to Moshe and Aharon. This connotes that we need two experts, like them, and we do not make a Beis Din with an even number of judges, so we add another, and there are three.

וכיון דשבת ונדרים סמיכי למועדות וכתיב במועדות אלה למעוטא משמע דממעט להו כל חד וחד למילתיה

Since Shabbos and Nedarim are [written] adjacent to Mo'adim, and it says regarding Mo'adim "Elu" to exclude, this connotes that we exclude each for its matter;

שבת לקידוש ב"ד דאיהי קבעה אנפשה ונדרים לומר דלא בעי' בהו מומחין דאפילו בהדיוטות סגי.

i.

Shabbos [is excluded for] Kidush Beis Din, for it fixes itself. (Every seventh day is Shabbos.) Nedarim [is excluded] to teach that it does not require experts. It suffices even with commoners.

Opinion #1 - Inference: Here it connotes that a lone expert can permit Nedarim only if he has Semichah, like an expert for Mo'adei Hash-m, [which we learn from] Moshe and Aharon;

דאין הפרש בין זה לזה אלא שמועדי ה' צריכין שלשה מומחין ונדרים סגי ביחיד

The only difference between them is that Mo'adei Hash-m need three experts, and for Nedarim one [expert] suffices.

Opinion #2: However, the Rambam wrote in Hilchos Shevu'os (6:5) that any outstanding Rav can permit alone (even if he does not have Semichah).

ולפ"ז אמרו דהא דפרכינן הכא והא בפרשת נדרים ראשי המטות כתיב לא פריך אמאי דאמר דפרשת נדרים אינה צריכה מומחה דראשי המטות לאו סמוכין משמע

Consequence: According to this, some said that the question here "in Parshas Nedarim it says Roshei ha'Matos!", does not challenge what we said that Parshas Nedarim does not need an expert, for Roshei ha'Matos does not connote Semichah;

דבכל דוכתי דבעי מומחין אלהים קרי להו והכא כיון דלא כתיב בהו אלא ראשי המטות פשיטא דלאו מומחה סמוך קאמר

Wherever we require experts, they are called Elohim. Here, since it says only Roshei ha'Matos, obviously we do not refer to an expert with Semichah!

i.

However, we challenge what we said that even three commoners [suffice], for Roshei ha'Matos does not connote experts, but even so they are not commoners.

Rav Chisda said a lone expert, i.e. he has learned and can reason.

Question: If so, what is the source for three commoners? From the exclusion "Eleh", we should say that we do not require experts like for Mo'adei Hash-m, but we should require that they have learned and can reason, like it says Roshei ha'Matos!

וכי תימא אי הכי מעוטא דאלה למה לי דהא מראשי המטות נמי משמע דלא בעיא מומחין וכדכתיבנא

Suggestion: If so (we would require that they have learned and can reason), what would we learn from the exclusion "Eleh"? Also from Roshei ha'Matos it connotes that we do not require experts, like I explained!

ליתא דאי מיעוטא דאלה דכתיב במועדי ה' לא מצית מוקמת ליה למילתא אחריתי שפיר קאמר

2.

Rejection: This is wrong. If we could not establish the exclusion "Eleh" written regarding Mo'adei Hash-m for something else, this would be correct;

אבל כיון דמצית מוקמת ליה למעוטי שבת שאין צריך קידוש ב"ד תו לא מייתר לך מעוטא דאלה

i.

However, since you can establish it to exclude Shabbos, which does not require Kidush Beis Din, the exclusion Eleh is no longer extra;

ומעוטא נמי שפיר מקיים לשבת בראשית ולפרשת נדרים דכתיב גבי מועדי ה' שאין אחד מהן שוה למועדות לקידוש ב"ד ולמומחין

ii.

Also, we can properly establish the exclusion for Shabbos Bereishis and Parshas Nedarim, which are written regarding Mo'adei Hash-m. Neither of them is equal to Mo'adim for Kidush Beis Din and experts;

ואכתי נבעי בנדרים תלתא דגמירי וסבירי

iii.

We would still require for Nedarim three who have learned and can reason!

וניחא לי דאי הכי סמיכותא דנדרים למועדי ה' למה לי

(f)

Answer: If so, what would be the reason for the adjacency of Nedarim to Mo'adei Hash-m?!

אלא ודאי כיון דאסמכינהו רחמנא גלי לן דמעוטא דאלה אנדרים נמי קאי

Rather, surely, since the Torah wrote them adjacently, it revealed to us that the exclusion Eleh refers also to Nedarim.

Question: For what [are Nedarim excluded]? If it is to teach that they do not require experts, we learn this from Roshei ha'Matos!

אלא ודאי דמשום סמיכותא משמע דלמעוט דנדרים נמי אתא

Answer: Rather, surely the adjacency connotes that it is also to exclude Nedarim.

והכי מדריש אלה דהיינו מועדות אפי' כשהן ג' צריכין מומחין דידהו דהיינו סמוכין

i.

We expound Eleh, i.e. Mo'adim, even when there are three, require their [level] of experts, i.e. Semichah;

אבל נדרים כל שהן ג' אינן צריכין מומחין דידהו דהיינו ראשי המטות דגמירי וסבירי אלא בחד מיניהו סגי כן נ"ל

ii.

However, Nedarim, as long as they are three, we do not need their [level] of experts, i.e. Roshei ha'Matos, who have learned and can reason. Rather, it suffices for one of them (the three, to have these attributes). So it seems to me.

ומייתו ראיה להך סברא דלא בעיא סמוך מדאזדקיק ליה רב לרב חננאל יחידי והא רב לאו סמוך היה

Support #1: They (those who derived from the Rambam that commoners do not suffice for Nedarim - (d) above) bring a proof for this reasoning, that we do not require Semichah, from Rav, who alone permitted Rav Chananel. Rav did not have Semichah!

ואי מהא לא איריא דבירושלמי משמע שנטל רשות מן הנשיא

(h)

Rebuttal: This is not a proof. The Yerushalmi connotes that he received permission from the Nasi;

Citation (cont.): After [Rebbi] died, [Rav] asked his son (R. Gamliel) for authority to rule about Mumim in Bechoros. [R. Gamliel] said "I do not add to what my father authorized you." (Rav was a great expert about Mumim. Rebbi did not authorize Rav, lest people extrapolate from his rulings. Alternatively, it was to show honor to Rabah bar bar Chanah - Sanhedrin 5b.)

Citation (cont. - R. Yosi bar Boon): [Rebbi] authorized [Rav] for everything, to judge [monetary cases] alone, to see stains, to permit vows, and to see open Mumim. From his son, he requested authority for covert Mumim. [R. Gamliel] said "I do not add to what my father authorized you."

Inference: Rav received permission. We can say that this is why he permitted alone.

Suggestion: The Yerushalmi proves oppositely, that we require Semichah. If not, why did Rav need permission?!

Rejection: This is not difficult. He received permission to enable him to permit Nedarim in a place where there are Chachamim greater than himself;

If not for permission, it is improper for a Talmid to permit a Neder in the region of his Rebbi.

Support #2: However, another episode in the Yerushalmi connotes that we do not require Semichah;

Citation (Yerushalmi): They told R. Yosi that Rav Huna permits vows. R. Zeira asked R. Yosi incredulously "is Rav Huna Roshei ha'Matos?!"

Support (of Opinion #2): The Rashbam wrote in Bava Basra (120b DH Hachi Garsinan) "also here, through a lone expert proficient in Gemara." I.e. he is an outstanding Rav;

Answer: Since it says Roshei ha'Matos, this implies that [Hataras] Nedarim is handed over to the most outstanding in the generation. R. Zeira thought that Rav Huna is not qualified for this;

ולפיכך אני אומר דלמאן דס"ל דלא בעינן סמוך כל שהוא רב מובהק בדורו מתיר יחידי

Therefore, I say that according to the opinion that we do not require Semichah, any outstanding Rav in the generation can permit alone.

והוצרכתי לכתוב זה מפני שראיתי מי שכתב דאפילו למאן דס"ל דלא בעי סמוך בזמן הזה ליכא מומחה דחזי להכי

I needed to write this because I saw someone who wrote that even according to the opinion that does not require Semichah, nowadays there is no expert proper for this [to permit alone];

והביא ראיה מן הירושלמי דהוה מתמה מעיקרא אפי' ברב הונא

He brought a proof from the Yerushalmi, which initially was astounded even about Rav Huna (why he may permit alone).

ולא נ"ל כן אלא אי לא בעי סמוך כל היכא דגמיר וסביר והוי מראשי המטות לפום דריה סגי.

Rebuttal: This is wrong. Rather, if we do not require Semichah, anyone who has learned and can reason, and is considered Roshei ha'Matos for his generation, suffices.

THE RAN EXPLAINS THE GEMARA

(a)

Gemara: One who is silent in order to vex.

כדי להקניט אשתו שתהא סבורה שדעתו לקיים נדריה והוא אינו מתכוין לכך אלא שיפר לה לאחר מיכן.

Explanation: In order to pain his wife, that she will think that he wants to affirm her vow, and he does not intend for this, rather, to annul for her later.

(b)

Gemara: When did they say that if the husband died, authority passes to the father?

פירשתיה למעלה /נדרים/ (דף סח).

Gemara: Does this not discuss silence in order to vex?

Explanation: Since he taught uniformly 'if he heard, was silent and died the next day, he cannot annul' this implies every silence, even in order to vex.

Gemara: No, [it discusses] silence in order to affirm.

Support: This is why we ask, 'if so, this is [the same as] he heard and affirmed!'

Gemara: Rather, he was silent Stam.

שלא גמר בלבו שיהא מקויים מעתה ולא שתק גם כן על מנת למיקט אלא שתק סתם.

Explanation: He did not resolve in his heart that it should be affirmed from now, and he was not silent in order to vex. Rather, he was silent Stam.
