THE RAN EXPLAINS THE GEMARA

(a)

Gemara: A Mishnah teaches there.

1.

Explanation: In Shabbos (157a).

(b)

Gemara: We annul vows.

1.

Explanation: A husband annuls for his wife.

(c)

Gemara: And we ask.

1.

Explanation: Vows to a Chacham [to permit them].

(d)

Gemara: We annul vows on Shabbos for a need of Shabbos.

1.

Explanation #1: 'For a need of Shabbos' refers to the entire Mishnah. Even Hafarah is only for a need of Shabbos.

2.

Explanation #2: Or, perhaps [Hafarah is] even not for a need of Shabbos. ['For a need of Shabbos'] refers only to She'elah.

i.

Reason #1: [She'elah is permitted only for a need of Shabbos] because a Chacham or three commoners are needed, so it looks like judgment.

ii.

Reason #2: The time for [permitting] She'elah will not pass (there is no deadline).

(e)

Gemara: Even during the day he cannot annul, for it is not needed.

1.

Explanation: Since she vowed close to dark, what need of Shabbos is it to annul it?

2.

Rather, surely, even not for a need, he may annul, since the time will pass, like it teaches 'if it became dark and he did not annul, he can no longer annul.'

3.

This is like we conclude, that it depends on the argument of these Tana'im.

(f)

Gemara: Tana'im argue about this.

1.

Explanation: Our Mishnah and Rav Tuvi's Beraisa do not contradict each other. Tana'im argue about this.

(g)

Gemara: According to the opinion that one may annul the entire day (i.e. until dark), but not no longer, [one may annul] even not for the need of Shabbos.

1.

Explanation: Since the time will pass, Chachamim were lenient to allow Hafarah not for a need [of Shabbos];

i.

She'elah is different, for one can ask [a Chacham] during the week.

(h)

Gemara: According to the opinion that one may annul me'Es la'Es (24 hours), [on Shabbos] one may annul [only] what is needed for Shabbos, but not what is not for the need of Shabbos.

1.

Explanation: [It is forbidden on Shabbos] because it is possible [to annul] during the week.

(i)

Conclusion: Regarding Halachah, we hold that Hafaras Nedarim is the entire day, and no longer. [Therefore] we annul Nedarim on Shabbos, even not for the need of Shabbos.

(j)

Gemara: A lone expert may [permit vows on Shabbos], but [a Beis Din of] three [commoners] may not, for this looks like judging a case.

1.

Explanation: We hold that we do not judge on Shabbos.

2.

Distinction: With a lone expert, even according to the opinion that 'expert' means that he received Semichah, like we will write with Hash-m's help, the matter is not recognized, and it does not look like judging on Shabbos.

(k)

Gemara: Since we hold [that judges may permit vows] even standing.

1.

Distinction: Whereas for judgment, it says in Shevu'os (30b) that [the judges] must sit.

(l)

Gemara: And even with relatives.

1.

Explanation: That are disqualified from joining.

(m)

Gemara: And even at night.

1.

Explanation: Which is not acceptable for [beginning] judgment.

(n)

Gemara: It does not look like judgment.

1.

Explanation: There is much recognition (that it is unlike judgment).

(o)

Gemara: Behold, this is [the law of] our Mishnah!

1.

Explanation: So what does Rav teach?

(p)

Gemara: Rather, say that the Halachah is, we ask [to permit] vows at night.

1.

Explanation: He needs to teach us that even though we require a Chacham or three commoners, which resembles judgment, even so, we may ask at night.

(q)

Gemara: Did you say 'I will give to you to drink?'

1.

Version #1: Rav Huna asked R. Aba, what you ask me 'did Rav say so?' - is it because you hold like the teaching, and you want to give to me a cup to drink"? (The Ran brings another version in the coming Dibur.)

2)

RAN DH Oh Ashtikan ka'Amrat [TRANSLATION: (Or,) did you say to be quiet?]

(SUMMARY: The Ran brings another version of the dialogue.)

(a)

Explanation: You are astounded how Rav could say so, and you intended to silence me.

(b)

Consequence: According to this, the text does not say "Ta Shma." Rather, it is a teaching by itself.

(c)

Version #2: 'Did Rav say so?' He said "Ishtik". He said 'did you say Ashkeich, or Ashtikeich?' He said "learn from the following. Rav Ika said... "

(d)

Explanation: 'Did Rav say so?' R. Aba asked this from Rav Huna, if he heard so explicitly from Rav. Rav Huna answered him that he (Rav Huna) said so in front of Rav, and Rav was silent;

1.

R. Aba asked Rav Huna, was Rav silent because he agreed to your words, like one who says to his friend "I will give to you to drink"? Or, perhaps he was silent to you, because he wanted to silence you, and he was not concerned to answer you?

2.

To resolve this, we bring that Rav himself permitted vows at night.

77b----------------------------------------77b

3)

THE RAN EXPLAINS THE GEMARA

(a)

Gemara: In the Kituna of the house of Rabanan.

1.

Explanation: In a room of the Beis Midrash.

(b)

Gemara: R. Gamliel holds that we are not Pose'ach with regret.

1.

Explanation: Rather, one must find a Pesach amidst the vow. Because one must investigate for a Pesach, he descended from the donkey and sat.

4)

RAN DH v'Rav Nachman... [TRANSLATION: And Rav Nachman holds that we are Pose'ach with regret.]

(SUMMARY: The Ran discusses how sitting relates to Posechim through regret.)

(a)

Explanation #1: Therefore, (since one need not seek a Pesach), he can permit even while standing.

(b)

Explanation #2: Rashi explained unlike this in Eruvin (64b. He said that "Posechim through regret" means that the Chacham must find a reason why had he known, he would not have vowed.)

(c)

Opinion #1: The Rashba said that for us, who hold that we are Pose'ach through regret, since initially we are Pose'ach through regret, and [the Chacham] need not sit...

1.

Even if he did not regret, and we must seek Pesachim to permit him, he need not sit. Since the initial law is standing, also the final law is standing.

(d)

Opinion #2: Since I do not understand his reason, I do not say so.

5)

THE RAN EXPLAINS THE GEMARA

(a)

Gemara: Did you see that Chacham who said...

1.

Explanation: That in the west (Eretz Yisrael), they say that one who vows, he sins.

6)

RAN DH Tanya ha'Omer l'Ishto [TRANSLATION: A Beraisa teaches, one who tells his wife...]

(SUMMARY: The Ran gives three explanations of the Beraisa.)

(a)

Explanation #1: If after she vowed, [he said] "all vows that you will vow, I do not want that you will vow, it is not my will that you vow from now and onwards", his words connote that what she vowed until now he is pleased with them, and he is Mekayem what she vowed until now;

1.

Even so, his words have no effect, for this is not Hakamah. If he wants, afterwards he may annul on the day he heard.

(b)

Distinction: However, if he said 'you did nicely when you vowed these vows", or he told her "there is no one like you", or "had you not vowed, I would put the vow on you", his words are fulfilled, for all these expressions connote Hakamah.

(c)

Consequence: According to this Perush, the entire Beraisa discusses Hakamah, just the expressions in the Reisha do not work, and the expressions in the Seifa work.

1.

According to this Perush, the text in this Beraisa does not say "[if he said] 'this is not a Neder', his words have no effect", for 'this is not a Neder' connotes only what she already vowed.

(d)

Explanation #2: The one whose text has these words ('this is not a vow'), he explains the Beraisa as follows. If one says to his wife about past vows "I do not want that you will vow", i.e. I do not want them, or he said "this is not a vow", his words have no effect, for Hafarah requires a clear expression;

1.

When it says "all vows that you will vow", it uses the future in place of the past. He means "that you vowed." We find like this in many places.

(e)

Explanation #3: Alternatively, "that you will vow" is precise. It is according to R. Eliezer, who says (75b) that a husband can annul vows that did not take effect;

1.

The Seifa teaches that granted, Hafarah requires an explicit expression, for Hakamah, one of these expression taught afterwards suffices.

(f)

Explanation: It seems to me that the reason is, since it was taught below that if he was Mekayem in his heart, it is Mekuyam, these expressions are no worse than Kiyum in his heart;

1.

However, regarding Hafarah, since we hold that Hafarah in his heart does not annul, even when he says words, his expression must be clear.

7)

RAN DH Tanya Lo Yomar... [TRANSLATION: A Beraisa teaches, one may not tell his wife on Shabbos 'it is annulled for you' or 'void for you' like he says during the week.]

(SUMMARY: The Ran explains why this is forbidden.)

(a)

Implied suggestion: We forbid saying so due to a decree lest a Chacham permit [on Shabbos].

(b)

Rejection: Since [rather,] he tells her 'take and eat', [we infer that] this is for the need of Shabbos, and even to ask [a Chacham to permit it on Shabbos] is permitted.

(c)

Explanation: Rather, the reason is, since it is possible to change [from how he says during the week], we change.

8)

THE RAN EXPLAINS THE GEMARA

(a)

Gemara: And he must annul it in his heart.

1.

Explanation: Even though he said to her 'take and eat', he must say in his heart that the vow is Batel.

(b)

Gemara: And during the week, he says it with his lips.

1.

Explanation: If she vowed during the week, he must say the Hafarah with his lips.

(c)

Gemara: This and this have the same law.

1.

Explanation: Shabbos and a weekday are the same.

9)

RAN DH Mevatel b'Libo v'Ein Tzarich... [TRANSLATION: He is Mevatel in his heart, and he need not say it with his lips.]

(SUMMARY: The Ran discusses when Hafarah in his heart suffices.)

(a)

Explanation: [He need not say it,] since he tells her "take and eat, take and drink." Also this Beraisa refers to the other [Beraisa].

(b)

Alternate text: Some texts say "at night", when it is Chol (Motza'ei Shabbos), he says with his lips. The entire [Beraisa] refers to one who vowed on Shabbos;

1.

Granted, on Shabbos she is permitted through Bitul in the heart. At night, when it is Chol, he must say with his lips.

(c)

Rebuttal: If so, how could Beis Hillel say "these are the same"?! Rather, surely the text does not say "at night."

(d)

Question: How could Beis Hillel say "these are the same - he is Mevatel in his heart, and he need not say it with his lips"?

1.

Granted, he tells her "take and eat, take and drink." Is this expression better than "there is no Neder here" or "I do not want you to vow"?

i.

We said above, according to the latter Perush that we wrote in that case, that this does not help for Hafarah!

2.

Suggestion: There is different, for he was not Mevatel in his heart.

3.

Rejection: A Beraisa below says that Hafarah in the heart does not help!

(e)

Answer: This is not difficult. It says below that Hafarah in the heart is not Hafarah, when he did not tell her "take and eat, take and drink." However, when he said so to her, Hafarah in the heart works;

1.

Implied question: "I do not want you to vow", or "this is not a Neder" does not work!

2.

Answer: Bitul in the heart is better, when he said "take and eat, take and drink", than when he was not Mevatel in his heart and said with his lips an inferior expression, i.e. "I do not want you to vow", or "this is not a Neder." Tosfos said so.

(f)

Remark: The Rambam has a different approach here. It is not clear. The Ra'avad already raised objections to it.

(g)

Implied question: The Beraisa above taught that one may not say to his wife on Shabbos "it is annulled for you" or "Batel for you" like he says during the week. (This implies that he must say so during the week!)

(h)

Answer: This does not mean that during the week, he must say so, for Beis Hillel say that both on Shabbos and during the week, as long as he said "take and eat" and was Mevatel in his heart, this suffices!

1.

Rather, it means [that he should not say to her] the way he normally says to her during the week.

10)

RAN DH Amar R. Yochanan Chacham... [TRANSLATION: R. Yochanan said, a Chacham who said in the expression of a husband.]

(SUMMARY: The Ran discusses which expressions help for a husband and for a Chacham )

(a)

Explanation: The Chacham said "it is Mufar for you", or the husband said in the expression of a Chacham "it is permitted to you."

1.

The expression of a husband is explicit in the Torah, i.e. an expression of Hafarah. [R. Yochanan] infers that the expression of a Chacham is "it is permitted to you", for it says "Lo Yachel Devaro", i.e. he may not make his words Chulin (profane);

2.

We expound 'however, others can profane [his vow] for him, and make it Chulin';

i.

Regarding Chulin, it is appropriate to say "permitted." (This Dibur continues on the coming Daf.)
