Gemara: We reject this; the case is, the Arus did not hear it, but the father heard.

ומשום שמיעה דאב הוא דקתני בו ביום ולאו לאשמועינן רבותא אלא דינא הכי הוא

Explanation: Due to the father hearing it, it taught "the same day." This was not to teach a Chidush. Rather, this is the law;

דכיון דאיכא שמיעה דאב דוקא בו ביום אבל למחר וליומא אחרינא לא.

Since the father heard it, only the same day [he can annul], but not the next day or a later day.

Gemara: If she vowed that day...

וקס"ד דבארוסה עסקינן וקתני אין יכול להפר אלמא גרושין כהקמה דמיין

Explanation: We are thinking that we discuss an Arusah, and it teaches 'he cannot annul.' This implies that divorce is like Kiyum.

והלכך על כרחך מתניתין דקתני בו ביום בשלא שמע ארוס ראשון ושמע אב עסקינן

Consequence: Therefore, you are forced to say that our Mishnah, which taught 'the same day', discusses when the first Arus did not hear, and the father heard.

Proof: If the Arus heard, since he divorced her, even if she became Mekudeshes the same day, he cannot annul!

Explanation: Really, I can say that divorce is like silence. Here, the reason [he cannot annul] is because we discuss a Nesu'ah, either at first (before divorce) or at the end (when he remarried her);

ומש"ה לא מצי מיפר דאין הבעל מיפר בקודמין

Therefore, he cannot annul, because a Ba'al cannot annul Kodmin.

הלכך אי ארוסה בתחלה ונשואה בסוף היא לא מצי מיפר דאין הבעל מיפר בקודמין

Therefore, if she was Arusah at first and Nesu'ah at the end, he cannot annul, because a Ba'al cannot annul Kodmin.

If she was Nesu'ah at first and Arusah at the end, also then he cannot annul, for once she had Nisu'in, [Reshus of] her father was uprooted, and an Arus can annul only in partnership.

Implied question: Why did the Gemara give the reason that a Ba'al cannot annul Kodmin? (This explains only the first case, but not the second case!)

Answer: This, i.e. the father was removed, is the reason [why a Ba'al, i.e. after Nisu'in, cannot annul Kodmin]. If not for this reason, would a Ba'al be weaker than an Arus [who can annul Kodmin]?!

Opinion #1: The Ramban wrote that the question was not resolved, so we are stringent. Divorce is like Hakamah;

והיכא דנדרה ושמע בעלה וגרשה ואהדרה ביומיה לא מצי מיפר לה

When she vowed, and her husband heard and divorced her and remarried her the same day, he cannot annul.

אבל הרשב"א ז"ל כתב דנהי דבעיין לא איפשיטא מהנך מתנייתא דמייתי' עלה אפשיטא לה ממימריה דשמואל

Opinion #2: The Rashba wrote that granted, the question was not settled from these Beraisos that we brought, but it is resolved from Shmuel's teaching;

He said above (71a) "what is the source that the last Arus can annul vows heard by the first?"

דאלמא קבלה מרביה דכי תנן במתני' בו ביום משום שמיעת ארוס נקט ליה ולא משום שמיעת אב

Inference: He had a tradition from his Rebbi that when the Mishnah says "that same day", it is because the Arus heard them, and not because the father heard them;

וכיון דשמואל אמר הכי לא שבקינן מאי דפשיטא ליה לשמואל משום מאי דאסתפקא להו בגמרא

Since Shmuel said so, we do not abandon what was obvious to Shmuel due to what the Gemara was unsure about.

וכי תימא א"כ מ"ט לא [פשטינן] בעיין ממימריה דשמואל

Question: If so, why didn't the Gemara resolve the question from Shmuel's teaching?

איכא למימר דממתני' או ממתניתא בעו למפשטה ולא ממימרא דאמוראי

Answer: We can say that the Gemara wanted to resolve it from a Mishnah or Beraisa, and not from a teaching of Amora'im.

Support: Similarly, above (35b) we asked whether Kohanim are our (Yisra'elim's) Sheluchim, or Hash-m's Sheluchim, and this was not resolved there;

Implied question: We could have resolved this from Rav Hamnuna, who taught in Kidushin (23b) that they are Sheluchim of Hash-m!

(a)

Mishnah: It is the way of Chachamim...

לפי שנערה המאורסה לאחר שנשאת אי אפשר שתהא הפרה לנדריה

Explanation: Because a Na'arah Me'orasah, after Nisu'in, her vows [before Nisu'in] cannot be annulled...

דרכן של אב ובעל כשהן תלמידי חכמים להפר נדריה קודם שתנשא

Therefore, it is the norm of a father and husband, when they are Chachamim, to annul her vows before she has Nisu'in.

ובגמרא מפרש הך הפרה אי קודם שמיעה היא אי לאחר שמיעה.

The Gemara explains if this Hafarah is before hearing or after hearing.

Mishnah: For if she will enter his Reshus, he cannot annul.

Gemara: Rami bar Chama asked, can a husband annul [his wife's vows] without hearing?

Explanation: E.g. he did not hear and does not know at all whether or not she vowed. Can he annul amidst Safek?

Gemara: All vows that you made will be annulled.

Explanation: The husband that Rami bar Chama asks about - there is no difference between an Arus, and husband (in Nisu'in), or her father. He is unsure about all of them.

Gemara: "V'Shama Ishah" - is this precise, or not?

אלא אורחא דמילתא נקט.

Gemara: Rava said, come and learn. It is the way of Chachamim... He did not hear!

Inference: Since it says 'all vows', this implies that he did not hear, for if he heard, he should have said 'Neder Ploni and Ploni' (specify the vows).

i.

Note: I do not understand this. It is easier to say 'all vows', and this avoids the possibility of omission (PF)! R. Akiva Eiger suggests a different inference - if he heard, he needed to annul that day! And if teaches about the day of her Chupah, let it teach 'a Chacham annuls his daughter's vows', which implies all of them, and while he can, i.e. before she leaves his Reshus!

ר"ן ד"ה לכי שמע הוא דמיפר

(g)

Gemara: When he will hear, he will annul.

כשישמע אח"כ נדרים שנדרה חוזר ומיפר אותן.

Explanation: When later he will hear the vows she vowed, he will return to annul them.

(h)

Gemara: If so, when he did not hear, why does he say so?

מה לו להפר על הספק הפרה שאינה מועלת כיון שסופו לחזור ולהפר כשישמע נדריה.

Explanation: Why should he annul amidst Safek, a Hafarah that does not help, since in the end he will return to annul after he hears her vows!

RAN DH Orchei d'Tzurba mi'Rabanan Le'ahadurei [TRANSLATION: It is the way of a Chacham to pursue.]

(SUMMARY: The Ran explains the benefit of doing so.)

דרכו של ת"ח לחזר עליה ולומר לה כל נדרים שנדרת הרי הן מופרים כדי להכניסה בדברים

Explanation: It is the way of a Chacham to strive [to annul her vows] and tell her "all vows that you vowed are annulled", in order to bring her to discuss this;

שמתוך כך היא נותנת אל לבה ואומרת נדר פלוני נדרתי והוא מפר

Amidst this, she will put to her heart and say "I vowed this vow", and he annuls it.

וכי תימא למה לן לדחוקי נפשין בהכי לימא הכא דאמר (גירסת כתב יד, הגהות ישנות) לכי שמענא

(b)

Question: What forced us to give this poor answer? [Rather,] say that here, he said "when I will hear"!

כלומר דקודם שמיעה אומר לה מופר ליכי לכי שמענא ומהני דהכי מתרצא לקמן

I.e. before he hears, he says "it will be annulled when I hear it." This helps, for so we answer below!

י"ל לא דמי דלקמן כי מתרצינן הכי ה"מ באומר לאשתו דלכי שמע נמי ברשותיה קיימא ומש"ה מהני

Answer: This is different. Below, when we answer so, this is when one says to his wife, for when he will hear, she is in his Reshus. Therefore, it helps;

אבל הכא דלכי שמע כבר יצאת מרשות אב שהרי נשאת כי אמר לה לכי שמענא מאי הוי הרי בשעת שמיעה אינה ברשותו.

However, here, when he will hear, she already left her father's Reshus, for she made Nisu'in. If he will tell her "when I will hear", what does this do? At the time that he hears, she is not in his Reshus!

RAN DH Ta Shma v'Chen ha'Ba'al... [TRANSLATION: Come and learn. And similarly, the husband... Here also, [he annuls them only] after he hears them. The Chidush is, it is a Chacham's way to pursue...]

Even so, granted, regarding the father, we cannot answer that he said "when I will hear", regarding a Ba'al we answer like this, that he said before hearing "when I will hear, this Hafarah will take effect."

דבשלמא אב לא מצי עביד הכי משום דבנשואין נפקא ליה מרשותיה לגמרי אבל בעל אדרבה בנשואין עיילא לה (הגהות ישנות) לרשותיה

Granted, a father cannot do so, for through Nisu'in she totally leaves his Reshus. However, a husband, just the contrary, through Nisu'in he brings her to his Reshus!

ומאי טעמא אמרינן דאין הבעל מיפר בקודמין משום דאסתלק ליה אב

Rhetorical question: Why do we say that a Ba'al cannot annul Kodmin? It is because the father was removed;

אבל הכא כיון דאב הפר חלקו קודם שנשאת ובעל נמי צרפה להפרה דידיה בהדי הפרה דאב (הגהה בגליון) קודם שנשאת

However, here, since the father annulled his share before she married, and the husband also joined his Hafarah to the father's Hafarah before she married...

נהי דכי חיילא לה הפרה דבעל אסתלק ליה אב אפילו הכי מיפר

Granted, when the husband's Hafarah takes effect, the father was removed. Even so, he can annul.

ואפשר נמי דלכי שמע משעה שהפר לה הוא דחיילא הפרה דיליה ואיכא צרופא מעליא דאב בהדי בעל זה נראה לי לפרש לפי גרסא זו.

(d)

Explanation #2: Also, it is possible that, when he hears, his Hafarah takes effect from when he annulled, and there is a proper joining of the father with the husband. So it seems to me to explain this text.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה ת"ש האומר לאשתו וכו' הרי הן קיימין לא אמר כלום

Gemara: Come and learn. One who tells his wife '... they are affirmed', it has no effect.

כדמפרש טעמא לקמן במתני'

Gemara: 'They are annulled' - R. Eliezer says, they are annulled.

לאו מדר"א בלחוד פשטיה אלא אפילו מדרבנן

Explanation: We do not resolve only from R. Eliezer, rather, even from Rabanan;

דעד כאן לא פליגי רבנן עליה דר"א אלא משום דאכתי לא חיילי וכדקא מהדרי ליה אינהו דכיון דלא באו לכלל הקם לא באו לכלל הפר (הגהות ישנות)

Inference: We find that Rabanan argue with R. Eliezer only because they did not take effect yet, like they say to him 'since they could not be affirmed, they cannot be annulled';

אבל הכא דבאו לכלל הקם (הגהות ישנות) לכ"ע מהניא אף על גב דלא שמע אלמא ושמע אישה לאו דווקא.

However, here that they could have been affirmed, it helps according to everyone, even though he did not hear. This shows that "v'Shama Ishah" is not precise.

Gemara: Here, he said 'when I will hear.'

Explanation (Tosfos): This does not mean that he says Stam 'it is annulled for you', and it is automatically annulled when he hears it;

RAN DH v'Ha Lo Shama Lei [TRANSLATION: Behold, he did not hear it!]

(SUMMARY: The Ran justifies the inference that he need not hear.)

כלומר בעל אלמא לא בעיא שמיעה

Explanation: The husband did not hear. This shows that he need not hear.

וכי תימא לעולם אימא לך דבעי שמיעה ושאני הכא דאיכא שמיעה דאפוטרופוס

(b)

Question: Really, I can say that he must hear. Here is different, for the overseer heard;

וכיון דשלוחו של אדם כמותו הוה ליה כאילו שמע בעל

Since a person's Shali'ach is like himself, it is as if the husband heard!

תרצו בתוספות בשם הרב רבי יוסף ז"ל דליתא דאם איתא דבעי שמיעה מי איכא מידי דבעל לא מצי מפר ושליח מצי משוי

Answer (Tosfos, citing R. Yosef): This is wrong. If we required that he must hear, there is no case in which the husband cannot annul, and he can make a Shali'ach [to annul]!

דהא מהאי טעמא גופיה אוקים לה להך ברייתא במסכת נזיר (דף יב:) כר"א דס"ל דאדם מיפר נדרי אשתו קודם שתדור

For this reason itself we establish this Beraisa in Nazir (12b) like R. Eliezer, who holds that a man can annul his wife's vows before she vows;

דאי לרבנן היכי לימא רבי יונתן מצינו בכל התורה כולה ששלוחו של אדם כמותו מי איכא מידי דאיהו לא מצי מיפר כיון דאכתי לא נדרה אשתו ושליח מצי משוי

Citation (12b): If it were like Rabanan, how could R. Yonason say "we find in the entire Torah that a person's Shali'ach is like himself"? Can it be that he cannot annul, since his wife did not vow yet, and he can make a Shali'ach [to annul]?

הלכך שפיר מוכח דלא בעיא שמיעה דכי שמע אפוטרופוס מאי הוי

Therefore, it is properly proven that he need not hear. The overseer's hearing does not help at all;

Since the husband cannot annul, since he did not hear, also the Shali'ach cannot annul.
