Explanation: However, Rabanan who argue with him (R. Eliezer) hold that whenever he forbade only his Hana'ah to him, but not his property, such a matter (Vitur) is not called Hana'ah;

דכיון דמידי דלא קפדי בה אינשי הוא אין זה קרוי נהנה מחבירו

Since people are not particular about it, it is not called benefiting from his friend. (Keren Orah says that it is not called Hana'ah from him. Turei Even (Megilah 8a) proves that such matters are called Hana'ah. He explains that Rabanan hold that the Madir did not intend to forbid them; the Rashbam (Bava Basra 57b) says that it is as if he was Mafkir his property to all for such Hana'os.)

ואם תאמר דהכא משמע דבדריסת הרגל לא קפדי אינשי ומש"ה שרו רבנן

Question: Here it connotes that people are not particular about Derisas ha'Regel (if others pass through their property), and therefore Rabanan permit;

ואילו בפ' חזקת הבתים (ב"ב דף נז:) אמרינן גבי אלו דברים שאין להם חזקה ואמרינן הכא בחצר של שותפות עסקינן דאהעמדה כדי לא קפדי

In Bava Basra (57b), regarding matters that have no Chazakah (uses of a Chatzer that do not establish that the owner authorized him to do so) we say "here we discuss a jointly owned Chatzer. [Partners] are not adamant about Ha'amadah (putting animals, ovens, millstones... on the property)."

אלמא דוקא שותפין הוא דלא קפדי הא אינשי דעלמא קפדי וכיון שכן ליתסר אפילו לרבנן

Inference: Partners are not adamant, but others are adamant [if strangers do so]. If so, even Rabanan should forbid!

תירץ הרמב"ן ז"ל דהעמדה דאמר התם היינו להתעכב ולישב בחצר דומיא דהעמדת בהמה דתנן התם במתני'

Answer (Ramban): The Ha'amadah discussed there is to delay and stay on the property, similar to Ha'amadah of animals that the Mishnah teaches there;

In such a case, we say that only partners are not particular, but others are particular;

However, here we discuss mere Derisas ha'Regel, i.e. to pass through his Chatzer and not delay there. In such a case, even others who are not partners are not particular. Therefore Rabanan permit.

(a)

Gemara: Regarding the Halachah.

פסק הרמב"ן ז"ל כר' אליעזר דאמר ויתור אסור כיון דסתם לן תנא הכא כוותיה ועוד דסוגיין דפ' השותפין שנדרו (לקמן /נדרים/ מח) כוותיה אזלא

Opinion #1: The Ramban rules like R. Eliezer, who says that Vitur is forbidden, since the Stam Mishnah here is like him. Also, the Sugya below (48b) is like him.

אבל ר"ח ז"ל כתב בפרק חזקת הבתים [גבי] אלו דברים שאין להם חזקה דלית הלכתא כרבי אליעזר וכן דעת ר"ת ז"ל.

Opinion #2: R. Chananel wrote in Bava Basra, regarding matters that do not have Chazakah, that the Halachah does not follow R. Eliezer. Also R. Tam holds like this.

Gemara: However, he vowed from food!

וכיון שכן למה יאסר.

Gemara: He said 'benefit from your food is forbidden to me.'

דכיון שהוסיף ואמר הנאת המאכל הרי אסר על עצמו כל מה שגורם אותו וקרי ליה מאכלך משום דבגרמת הנאה שלו הוא מתוקן

Explanation: Since he added, and said 'benefit from your food', he forbade to himself all that causes it. He calls it 'your food', because benefit that he caused, it prepared the food.

והוה סלקא דעתך הכי דאי לא מאי מיקרי הנאת מאכל.

We are thinking so, for if not, what is called 'benefit from food'?

Gemara: We should say that [the Madir] may not chew wheat and put it on [the Mudar's] wound!

דהנאת מאכל לא משמע אלא שלא יהנה מגוף המאכל עצמו ולאסור אפי' הנאת המאכל אמר הנאת מאכלך ואכתי לישתרי.

Explanation: 'Benefit from food' implies that he may not benefit from the food itself. He said 'benefit from your food', to forbid even benefit (other than eating) of the food. Still, [Kelim used to prepare food] should be permitted!

RAN DH Amar Rava b'Omer Hana'ah ha'Mevi'ah... [TRANSLATION: Rava said, he said 'benefit [from you] that leads to food is forbidden to me.]

(SUMMARY: The Ran holds that this does not forbid putting chewed wheat on his wound.)

Explanation #1: Some say that in such a case he is forbidden both putting wheat [that the Madir chewed] on his wound, and [borrowing from him] a sieve or sifter.

Rebuttal: "Hana'ah that brings to food" does not connote putting chewed wheat on his wound!

Explanation #2: Rather, the law is as follows. If he vowed from food, he is forbidden only eating [his friend's food], and he is permitted everything else;

If he said "Hana'ah from your food is forbidden to me", he may not eat, and [the Madir] may not chew wheat and put it on [the Mudar's] wound. However, [the Mudar] may borrow from him a sieve or sifter;

If he said "Hana'ah that brings to food is forbidden to me", he may not eat or borrow a sieve or sifter. However, [the Madir] may chew wheat and put it on [the Mudar's] wound. So it seems to me.

Gemara: A sack [or donkey] to bring produce on it... is considered benefit that leads to food.

דלא תימא לא מקריא הנאה המביאה לידי מאכל אלא לתקן המאכל בנפה וכברה אבל להביא אליו המאכל בלבד בשק וחמור שרי קמ"ל רב פפא.

Explanation: Do not say that preparing the food with sieve or sifter, only this is called benefit that leads to food, but just to bring to him the food via a sack or donkey, it is permitted - Rav Papa teaches that this is not so.

Explanation: Do we say that granted, bringing the food closer to him is called Hana'ah that brings to food...

Even so, bringing himself closer to the food, e.g. to pass through his land to get there quickly, is not Hana'ah that brings to food.

There (bringing the food closer) is different, for he does [something] to the food itself.

וכן נמי סוס לרכוב עליו וטבעת (הגהה בגליון) ליראות בה כדי שיראה כאדם חשוב כשירכוב על סוס ותהא טבעת על ידו ובשביל זה יתנו לו מנה יפה

The same applies to a horse to ride on and a ring to be seen with it, so he will appear to be an important person when he rides on a horse and has a ring on his hand, and due to this they give to him a nice portion;

כי האי גוונא גרמא בעלמא הוא.

[Perhaps] such a case is mere Gerama (causation, so it is permitted).

Gemara: If you will say that he will not be seen with them [and get a better portion due to this], does this need to be taught?!

דשרי במודר מאכל כיון דאין משכירין בהן כיוצא בהן פשיטא

Explanation: It is permitted to one who is Mudar Ma'achal, since people do not rent out these things. Obviously it is permitted!

Gemara: Rather, it is even to be seen with them, and it taught that he may lend to him.

Inference: Causing [the Mudar to get] food is permitted, and all these questions of Rav Papa are mere causation.

Gemara: Since the Reisha taught that he may not lend to him...

THE RAN EXPLAINS THE MISHNAH

ר"ן ד"ה מתני'. מקום שמשכירין כיוצא בהן אסור

Mishnah: In a place where such [Kelim] are rented, it is forbidden.

אפי' במודר מאכל דהאי מודר מאכל דמתני' הא מוקמת ליה בגמרא באומר הנאה המביאה לידי מאכל עלי

Explanation: Even for one who is Mudar Ma'achal, for the Gemara establishes the Mudar Ma'achal of our Mishnah to be one who says 'benefit that leads to food is forbidden to me';

והני כיון דרגילין להשכירן וזה משאילו בלא שכר הנאה המביאה לידי מאכל היא שהרי בדמי השכירות שמחל לו יקח מאכל.

These [Kelim], since they are normally rented, and he lends to him for free, this is benefit that leads to food, for with the rental money that he pardoned him, he can buy food.

Gemara: This implies that the Reisha...

Explanation: I.e. he may not lend to him a sieve or sifter.

Explanation: The Madir may give for the Mudar. The same applies to paying his debt. The Gemara will explain the reason.

Mishnah: He may return his Aveidah to him.

Explanation: He does not give to him anything [that he did not already own]. He merely returns to him what is his.

Mishnah: In a place where people receive wages [for this].

דהיינו אם היה מחזיר בטל מן הסלע דבכי האי גוונא מחייב בעל אבידה ליתן לו שכר כדאיתא באלו מציאות (ב"מ דף ל:).

Explanation: I.e. if the one who returned was idle from a Sela [he would have earned a Sela had he kept working and not returned the Aveidah]. In such a case, the owner of the Aveidah is obligated to pay his wage, like it says in Bava Metzi'a (30b. If not, he must return it for free.)

(g)

Mishnah: The Hana'ah goes to Hekdesh.

אם אין מחזיר רוצה לקבל השכר יתננו מודר להקדש שאילו היה מוחל לו מדיר נמצא מהנהו.

Explanation: If the one who returns his Aveidah does not want to receive the wage, the Mudar gives it to Hekdesh. If the Madir would pardon him, it turns out that he benefits him.

RAN DH Gemara Alma Avuchei Ari Be'alma Hu v'Shari [TRANSLATION: We infer that he merely chases away a lion (prevents a loss).]

Explanation: This refers to giving his [half-]Shekel and paying his debt;

It is permitted because he does not give anything to him. He merely removes [the claim of] the lender from him.

This is also why he may give his [half-]Shekel, for he does not benefit [him at all]. Even without this, [the Mudar] has a share in Korbanos Tzibur;

Source (Kesuvos 108a, Bava Metzi'a 58a - Mishnah): We are Torem (take boxes of Shekalim from all the Shekalim in the chamber, to buy Korbanos Tzibur) with intent for what was lost, was collected, and will be collected. (This shows that he has a share even before he gives his Shekel.)

מאי אמרת הא קא מהני ליה דפרע חובו אברוחי ארי הוא ושרי.

Will you say that he benefits him through paying his debt? [No!] This is mere Mavri'ach Ari (preventing damage), and it is permitted.

Gemara: R. Oshaya said, who is the Tana? It is Chanan.

דס"ל שהמפרנס אשת חבירו שפורע לו חוב מזונותיו הניח מעותיו על קרן הצבי משום דלא חשיב מהני אלא מבריח ארי בעלמא.

Explanation: He holds that one who finances another's wife, i.e. he paid the husband's obligation of food [for his wife], he threw away his money (the husband need not pay him), for he does not consider this giving benefit, rather, mere Mavri'ach Ari.

(SUMMARY: The Ran explains how Rabanan can agree about paying his loan and Shekel.)

I.e. when he lent to him, he stipulated that he will not have power to force him. Rather, when the borrower wants, he will pay him willingly.

הלכך כי פרע ליה מדיר לאותו חוב דאע"ג דאפשר דמודר משום כסופא פרע ליה אפ"ה כיון דאי בעי לא פרע ליה לאו מידי יהיב ליה למודר

Therefore, when the Madir pays the debt, even though it is possible that the Mudar would have paid due to shame, even so, since if the Mudar did not want, he would not pay, he (the Madir) did not give anything to the Mudar.

וכ"ת תינח פורע לו חובו אלא שוקל לו את שקלו היכי שרי אליבא דרבנן

(b)

Question: Granted, we can say so for paying his debt. Why may he give his [half-]Shekel according to Rabanan?

איכא למימר דמתניתין לדידהו משכחת לה כגון ששלח את שקלו ונגנב או אבד משנתרמה תרומה דכי ה"ג פטור מלשלם

(c)

Answer: According to them, our Mishnah discusses one who sent his Shekel, and it was stolen or lost after Terumah was taken. In such a case he is exempt from paying [another Shekel];

כדתניא בהזהב (ב"מ נז:) בני העיר ששקלו את שקליהם ונגנבו או אבדו אם משנתרמה תרומה נשבעין לגזברים

Source (Bava Metzi'a 57b - Beraisa): If people of a city sent their Shekalim, and they were stolen or lost, if Terumah was already taken, they (the Sheluchim) swear to the Gizbarim [and they are exempt].

הלכך כי שוקל מדיר את שקלו מידי דלא מחייב בה מודר קיהיב

Therefore, when the Madir gives his Shekel, he gives something that the Mudar was not obligated to give.

וקמ"ל שאע"פ שהיה דרכן לפרוע אותו שרי כיון שאין הגזברים יכולין לכופו.

The Chidush is that even though people normally did pay [again in such a case], it is permitted, because the Gizbarim cannot force him.

RAN DH Gezeirah she'Lo Lifro'a Atu Lifro'a [TRANSLATION: This is a decree of [a loan on condition] not to pay due to [a normal loan, which is on condition to] pay.]

(SUMMARY: 1. The Ran brings a different reason than it says in Kesuvos. 2. He concludes that Chanan's teaching applies even in a Stam case, unlike the Rashba.)

Explanation: If we say that the Madir may pay the Mudar's debt when he borrowed on condition that he need not repay, we should decree lest he pay even in a case when the Mudar borrowed on condition that the lender can force him to repay;

הלכך אי מתני' רבנן ליכא גוונא דשרי אלא ודאי חנן היא ומותר בכל ענין,

Therefore, if the Mishnah is Rabanan, there is no case in which it is permitted. Rather, surely it is Chanan, and it is permitted in every case.

ובפרק שני דייני גזירות (כתובות קח) מסקינן בגוונא אחרינא דאמר התם נהי דהנאה לית ליה כסופא מי לית ליה

(b)

Reference: In Kesuvos (108a) we conclude differently. It says there [that R. Hoshaya did not answer like Rava because] "granted, he has no Hana'ah [through the Madir paying]. Does he have no shame?!" (He benefits from being saved from shame.)

Distinction: When a man financed the wife [of a man who went away], Chanan holds that he threw away his money. The Rashba wrote that this is only when he specified that he does so for food that her husband is obligated to give to her. In such a case, Chanan exempts;

אבל פרנס סתם חוזר וגובה לפי שכל המפרנס סתם אינו מפרנס בתורת מתנה אלא בתורת הלואה

However, if he financed her Stam, he collects it back, for everyone who finances Stam does not do so for a gift, rather, for a loan;

ונמצא שהיא חייבת לו ומי שפרנס אותה גובה ממנה והיא גובה מבעלה

It turns out that she is obligated to pay him, and the one who financed her collects from her, and she collects from her husband.

וכמו שפרש"י ז"ל בפרק שני דייני גזירות גבי לוותה ואכלה היא (הגהת הרש"ש) נפרעת מבעלה ובעל חוב גובה ממנה

Support: This is like Rashi explained in Kesuvos regarding [a woman] who borrowed and ate. She collects from her husband, and the creditor collects from her.

והביא ראיה דהמפרנס סתם לא אמרי' במתנה קיהיב אלא לשם הלוואה מיורד לתוך שדה חבירו ונטעה שלא ברשות (כתובות פ ב"מ קא)

Proof #1: He (the Rashba) brought a proof that one who finances Stam, we do not say that he give a gift. Rather, it was a loan. We learn from one who entered his friend's field and planted it without permission (Kesuvos 80a, Bava Metzi'a 101a);

דחייב בעל השדה לשלם ולא כל הימנו שיאמר במתנה נתת לי

The owner of the field must pay him [the lesser of the expenditure and the increased value]. He cannot say that he gave (planted) for a gift.

ועוד ראיה מדגרס בירושלמי בפרק איזהו נשך חד בר נש אישאל לחבריה דינרין אשריתיה גו ביתיה

Proof #2: He brought another proof from the text in the Yerushalmi in Bava Metzi'a (5:1). A man borrowed Dinarim from his friend, and let him (the lender) dwell in his house;

אמר ליה הב לי דינרי אמר ליה הב לי אגר ביתי אתא עובדא קמיה דר' אבא זבינא ומריקו ליה מאי דהוה חמי למשרייה

Citation (Yerushalmi): When the lender asked for the money, the borrower asked for rent money. The case came in front of R. Aba Zevina, and he deducted the proper amount for rental.

והכא ודאי בשהעמידו סתם בתוך ביתו מיירי ולא בשהעמידו בפירוש בשכר דא"כ לא הוה אמר ליה אידך הב לי כל דינרי דהוה פרע ליה מה שהתנה עמו לתת לו בשכירותו

We discuss when he let him stay there Stam in his house. He did not explicitly stipulate for rental, for if so, the lender would not have requested the entire loan. He would have paid (deducted) what he stipulated to pay to him for rental!

וכן נמי ליכא למימר דמשום רבית קאמר

Suggestion: Perhaps that was due to Ribis. (Normally, we say that it was a gift. Here we cannot, for it would look like Ribis.)

דא"כ הוה ליה למימר נכה לי אגר ביתי

(h)

Rejection: If so, he should have said "deduct for me the rental of my house"! (Shalmei Todah - if he was entitled to rental only because there was a loan, his only claim is to deduct from the loan. Rather, he asked to be paid rental, i.e. in every such case he is entitled to collect rental, even if there was no loan.)

אלמא המשרה חבירו בתוך ביתו סתם לא למתנה איכוון אלא לשכירות

Inference: One who houses his friend in his house Stam does not intend for a gift, rather, for rental.

משום דנהי דלאו בתורת מתנה קעביד מיהו סתמא זו אדעתא דבעל נחית ולאו אדעתא דידה

This is because granted, he does not intend for a gift. However, Stam he gives with intent for the husband (that he will pay him back), and not with intent for her;

שכבר הוא יודע שאין לאשה זו נכסים שיהא נפרע מהן אלא מבעלה

He already knows that a woman does not have property from which he can be paid. Rather, [he intends to be paid] from her husband;

ולא מסיק אדעתיה לומר שתתחייב היא בהן כדי שתוכל לגבות מבעלה ולהגבותו דלאו כולהו אינשי דינא גמירי אלא סתמא אדעתא דבעל נחית

It does not cross his mind to say that she will be obligated, so she can collect from her husband and pay him. Not everyone knows monetary laws. Rather, Stam he intends for [getting paid back from] the husband.

Therefore, granted, he does not do so (feed her) for a gift, like the Rashba's proofs show;

ר"ן ד"ה ולענין הלכה

(SUMMARY: The Ran rules like Chanan, even regarding a pressing creditor, and when there is a security.)

קיי"ל כחנן הלכך פורע חובו של חבירו הניח מעותיו על קרן הצבי

(a)

Pesak: We hold like Chanan. Therefore, one who pays his friend's debt, he threw away his money.

ואפילו בבעל חוב דוחק נמי דליכא למימר דטעמא דחנן משום דמצי אמר ליה מפייס הוינא ליה והוה מחיל לי

This is even regarding a creditor who presses [for payment], and we cannot say that Chanan's reason is because [the borrower] can say "I would have appeased him, and he would have pardoned me."

דהא מתני' דשוקל לו את שקלו אתיא לן שפיר כחנן אף על גב דלא מצי אמר שימחלו לו הגזברים

Proof: Our Mishnah of paying his Shekel is fine like Chanan, even though one cannot say that the Gizbarim would have pardoned him.

Assertion: Presumably, even regarding a loan with a security, he (one who paid for his friend) lost his money.

Even though the Bavli holds that Bnei Kohanim Gedolim do not agree, we learn from the Yerushalmi that Chanan said even regarding a loan with a security;

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה מידעם דנפשיה קא מהדר ליה

(a)

Gemara: He returns [to the Mudar] his own property.

ולא מהני ליה מידי אלא שמבריח נזק אבידתו מעליו.

Explanation: He does not give to him anything, rather, he is Mavri'ach (prevents damage) to his Aveidah.

ר"ן ד"ה דקא מהני ליה פרוטה דרב יוסף

(b)

Gemara: He gives to him benefit - the Perutah of Rav Yosef.

דכי מהדר ליה אבידתו מיפטר מלמיתב ליה פרוטה לעני שהעוסק במצוה פטור מן המצוה

Explanation: When he returns his Aveidah, he is exempt from giving a Perutah to an Oni, for one who is engaged in a Mitzvah is exempt from [another] Mitzvah.

ותלי לה בדרב יוסף משום דפליגי רבה ורב יוסף פ' הכונס צאן לדיר (ב"ק נו:) בשומר אבידה אי הוי כשומר שכר

This is attributed to Rav Yosef, because Rabah and Rav Yosef argue in Bava Kama (56b) about whether a Shomer Aveidah is a like a Shomer Sachar;

וסבירא ליה לרב יוסף דכיון דמיפטר מלמיתב פרוטה לעני שומר שכר הוי.

Rav Yosef holds that since he is exempt from giving a Perutah to an Oni, he is a Shomer Sachar.

Gemara: The Perutah of Rav Yosef is not common.

Explanation: It is not common that an Oni will come at that time, that we should say that he may not return, for he benefits from this.

דכי האי גוונא כיון דלא שכיח לא הוי בכלל איסור הנאה

In such a case, since it is not common, it is not included in the Isur Hana'ah.

ומיהו כיון דאפשר דאתי ומתהני מינה שומר שכר הוא עליה וחייב בגניבה ואבידה.

However, since it is possible that [an Oni] will come, and he will benefit from [the Aveidah], he is a Shomer Sachar on it, and he is liable for theft or loss.
