THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה אפי' עובדי כוכבים נמי

Gemara: Even a Nochri, also.

כלומר ה"ל למתני אסור במקיימי השבת כדי שיהו בכלל כל העובדי כוכבים השובתים.

Explanation: I.e. it should have taught that he is forbidden those who fulfill [the restrictions of] Shabbos, in order to include all Nochrim who cease [from Melachah on Shabbos].

ר"ן ד"ה אמר אביי מצווה ועושה קתני

Gemara: Abaye said, the Mishnah teaches those who are commanded and observe.

כלומר שאין בכלל דבריו אלא מצווין ועושין.

Explanation: I.e. his words include only those who are commanded and observe.

ר"ן ד"ה בתרתי קמייתא

Gemara: In the first two.

דהיינו שביתת שבת ואכילת שום ישראל וכותים מצווין ועושין.

Explanation: I.e. resting on Shabbos and eating garlic. Yisrael and Kusim are commanded and observe.

Mishnah: 'Konam, I will not benefit [from] Bnei Noach', he is permitted with Yisrael.

ואף על גב דישראל נמי בני נח נינהו כיון דאיתקדש אברהם אבינו איקרו על שמיה ולא על שם נח.

Explanation: Even though also Yisrael descend from Noach, since Avraham Avinu was sanctified, they are called on his name, and not on Noach's name.

Mishnah: 'I will not benefit [from] the seed of Avraham', he is forbidden with Yisrael, and permitted with Nochrim.

דאפי' בני ישמעאל ועשו לא מיקרו זרע אברהם כדמפ' בגמרא.

Explanation: Even Bnei Yishmael and Esav are not called Zera Avraham, like the Gemara explains.

Gemara: 'I will not benefit [from] Yisrael, he buys for more [than the value].

כדי שלא יהנה מהם במה שהוא לוקח.

Explanation: This is lest he benefit from them through selling [to them];

דמתניתין מוקמינן לה בגמרא בזבינא מציעתא דאיכא הנאת לוקח ומוכר כל שהוא נמכר שוה בשוה

In the Gemara, we establish our Mishnah to discuss an average sale in which the buyer and seller both benefit if it is sold for the value.

וכי אמרי' דבפחות וביתר שרי דוקא כשאסר על עצמו שלא יהנה מישראל דבכי ה"ג לא מתהני מינייהו

Limitation: We say that it is permitted [to sell] for less and [buy] for more, this is only when he forbade himself to benefit from Yisrael. In such a case, he does not benefit from them;

אבל אי אסר על עצמו נכסיהם אפי' לקח שוה מנה במאתים אסור להנות ממקחו שנדרו כבר חל על נכסיהם.

However, if he forbade their property to himself, even if he bought property worth 100 for 200, he may not benefit from his purchase, for his vow already took effect on their property.

ר"ן ד"ה שישראל נהנים לי

(a)

Mishnah: 'That Yisrael will not benefit Li.'

כלומר שאסר הנאתו על ישראל.

Explanation: I.e. he forbade benefit from himself to Yisraelim.

RAN DH Loke'ach b'Pachos v'Mocher b'Yeser v'Ein Shom'in Lo [TRANSLATION: He buys for less and sells for more, and they do not heed him.]

ר"ן ד"ה לוקח בפחות ומוכר ביתר ואין שומעין לו

(SUMMARY: The Ran discusses whether this applies to property that he acquires afterwards.)

כלומר אין לו תקנה ליקח ולמכור לישראל אלא א"כ יקח בפחות וימכור להם ביותר כדי שלא יהנו ממנו

Explanation: His only solution to buy and sell with Yisre'elim is if he buys for less [than the proper price] and sells to them for more, lest they benefit from him;

אבל אין שומעין לו בני אדם להפסיד ממונם

However, they will not heed him to lose money [through paying extra or selling for less].

ואית דגרסי אי שומעין לו בחיריק כלומר אם שומעים לו

Alternate text: Some texts say "Iy Shom'in Lo", with a Chirik, i.e. if they heed him.

אבל בלאו הכי לית ליה תקנתא ואפי' בנכסים שקנה לאחר נדרו

Explanation #1: If not (they do not heed him), he has no solution, even regarding property that he [or they] bought after his vow.

דאע"ג דקיי"ל דאין אדם אוסר דבר שלא בא לעולם על חבירו

Implied question: We hold that a person cannot forbid Davar she'Lo Ba l'Olam (something that is not yet in the world) to someone else!

הני מילי כשאוסר בפירוש דבר שלא בא לעולם כפירות דקל או פירות שעתיד לקנות

Answer #1: That is when he explicitly forbids Davar she'Lo Ba l'Olam, e.g. fruits [that will grow] on a date tree, or Peros that he will buy in the future.

Answer #2 (and Explanation #2): The case is, he said "my property is forbidden to you." Only property that he had at the time is forbidden.

Answer #3: What was exchanged for property [that he had at the time, is forbidden], for it is like Gidulin (what grows from what he had at the time). The Gemara asks about this below (47a).

Distinction: If he forbade benefit from himself to his friend, since the Isur Hana'ah depends on him, and he is in the world...

It turns out that if he sells to Mudarim property that he acquired afterwards, for the proper price, he benefits them. Therefore, it is forbidden.

RAN DH she'Eini Neheneh Lahem v'Hem Li... [TRANSLATION: 'I will not benefit from them, and they will nor benefit from me, he benefits from Nochrim.]

(SUMMARY: The Ran explains the Chidush of this.)

כתב הר"א ז"ל דהא קמ"ל דלא תימא כיון דהכי נדר אי אפשר לו לעמוד בנדרו

Explanation (Ra'avad): The Chidush is that we do not say that since he vowed like this, he cannot fulfill his vow;

והוה ליה כי ההיא דאמר לעיל בפרק ואלו מותרין (דף טו) שבועה שלא אישן שלשה ימים מכין אותו וישן לאלתר

[We would say that] he is like the one who said above (15a) "Shevu'ah, I will not sleep for three days." We lash him [for a vain oath], and he may sleep immediately;

והכי נמי נימא דיהנה לאלתר דדבר שאי אפשר לעמוד בו הוא

Also here, we should say that he may benefit immediately, for it is impossible to fulfill it!

קמ"ל דלא כיון דאיכא תקנתא בעובדי כוכבים אף על פי שהיא תקנה דחוקה (הגהות ישנות) לו.

The Mishnah teaches that this is not so, since there is a solution through Nochrim, even though it is a difficult solution for him.

RAN DH Amar Shmuel ha'Loke'ach Kli Min ha'Tagar... [TRANSLATION: Shmuel said, if one took a Kli from a merchant...]

ר"ן ד"ה גמ' אמר שמואל הלוקח כלי מן התגר...

(SUMMARY: The Ran points out that our Sugya relies on the Sugya in Bava Basra, and vice-versa.)

אוקמינן התם בפ' הספינה (ב"ב פח) בדקיצי דמיה הלכך סמכא דעתיה דלוקח שאם רצה ללקחן הרשות בידו

Explanation: There in Bava Basra (88a) we establish this to be when the price is fixed. Therefore, the buyer is confident that if he wants to buy them, he may.

וכיון שכן חייב באונסין דבמקח כל הנאה ללוקח היא ולא למוכר והוה ליה כשואל (הגהה רע"א) דמשום דכל הנאה שלו חייב באונסין

Therefore, he is liable for Ones, since the buyer gets all the benefit from the sale, and not the seller. He is like a borrower. Because all the benefit is his, he is liable for Ones.

Implied question: Here, the Gemara was not concerned to explain that Shmuel discusses when the price is fixed!

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה ואי הנאת לוקח היא אפילו שוה בשוה נמי

(a)

Gemara: If the buyer benefits from a sale, even for the true value should be permitted!

דהא אמרת דבמקח ליכא הנאת מוכר.

Explanation: For you said that the seller does not benefit from a sale.

ר"ן ד"ה מתני' בזבינא דרמי על אפיה

(b)

Gemara: The Mishnah discusses an item that is hard to sell.

הלכך שוה בשוה הנאת מוכר היא שאינו מוצא לוקחין

Explanation: If it is sold for the proper value, the seller benefits, for he does not find buyers;

ולאו הנאת לוקח דכיון דלא קפיץ עליה זבינא מצוי הוא תמיד ללוקח ואינו נהנה במקחו

The buyer does not benefit. Since people are not eager to buy it, it is always available to buy. He does not benefit from his purchase.

ודשמואל בזבינא חריפא ומש"ה הנאת לוקח היא שהכל קופצין עליו ואין למוכר שום הנאה במכירתו דהא כל אימת דבעי מזבין ליה.

Shmuel discusses an item in great demand. Therefore, the buyer benefits, for all are eager to buy it. The seller has no benefit from his sale, for whenever he wants, he can sell it.

ר"ן ד"ה א"כ אימא רישא לוקח ביתר

Gemara: If so, why does the Reisha say that he buys for more [than the value]?

וכיון דזבינא דרמי על אפיה הוא למה ליה ליקח ביתר אפילו לוקח שוה בשוה לא מיתהני ביה איהו כלל אלא מוכר כיון דזבינא דרמי על אפיה הוא

Explanation: Since the item is hard to sell, why must he buy for more [than the value]? Even if he buys for the value, he does not benefit at all. The seller benefits, since it is hard to sell!

ועוד אימא סיפא היכא דאסר הנאתו על ישראל דקתני מוכר ביתר ואי זבינא דרמי על אפיה הוא אפילו שוה בשוה דליכא הנאה ללוקח כלל אלא למוכר.

Further, the Seifa says, when he forbade Hana'ah from himself to Yisrael, he sells for more [than the value]? Even if he buys for the value, he does not benefit at all. The seller benefits, since it is hard to sell!

ר"ן ד"ה סיפא בזבינא חריפא

(d)

Gemara: The Seifa [discusses] an item that is in demand.

כלומר רישא אשמועינן דינא דזבינא דרמי על אפיה וסיפא אשמועינן דינא דזבינא חריפא

Explanation: The Reisha teaches the law of an item that is hard to sell, and the Seifa teaches the law of an item that is in demand.

ומיהו אכתי לא מפרקא קושיין אמאי רישא לוקח ביתר אלא לפרוקי קושיא דסיפא אתינן.

However, we still did not answer our question, why in the Reisha must he buy for more? Rather, we come to answer the question from the Seifa.

ר"ן ד"ה אי הכי לוקח בפחות אפי' שוה בשוה נמי

Gemara: If so, why must he buy for less [than the value]? Even for the exact value [should be permitted]!

דהאמר שמואל דבזבינא חריפא לוקח מתהני ולא מוכר דמשום הכי חייב באונסין לפי שכל הנאה שלו.

Explanation: Shmuel said that for an item in demand, the buyer benefits, and not the seller. This is why [one who took such a Kli from a merchant] is liable for Ones, since he has all the benefit.

RAN DH Masnisin bi'Zvina Metzi'a u'Shmuel bi'Zvina Charifa [TRANSLATION: Omw discusses an average sale, and Shmuel discusses an item in demand.]

ר"ן ד"ה מתניתין בזבינא מציעא ודשמואל בזבינא חריפא

(SUMMARY: The Ran explains who benefits from a sale, in every case.)

כלומר דבזבינא מציעא איכא הנאת מוכר ולוקח ומש"ה כשאסר הנאת ישראל עליו לוקח ביתר ומוכר בפחות כי היכי דלא לתהני

Explanation: In an average sale, the seller and buyer benefit. Therefore, when he forbade Hana'ah from Yisre'elim to himself, he buys for more and sells for less, lest he benefit;

וכשאסר הנאתו על ישראל לוקח בפחות ומוכר ביתר כי היכי דלא ליתהנו אינהו

When he forbade Hana'ah from himself to Yisre'elim, he buys for less and sells for more, lest they benefit;

דבזבינא מציעא כי מזבן ליה שוה בשוה תרוייהו מתהנו

This is because in an average sale, when he sells for the proper price, both of them benefit.

ונראה בעיני דגמרא ודאי כי מוקי מתני' בזבינא דרמי על אפיה א"נ בזבינא חריפא מידע ידע דמתני' לית לה אוקימתא בהכי

Assertion: It seems to me that surely, when the Gemara establishes our Mishnah to discuss a Zevina Charifa (an item in demand), or a Zevina d'Rami Al Apei (it is hard to sell), it knew that we cannot establish the Mishnah to discuss this;

אלא לגלויי דיני קא בעי ולאשמועינן דזבינא דרמי על אפיה הנאת מוכר ולא לוקח וזבינא חריפא הנאת לוקח ולא מוכר וזבינא מציעא הנאת שניהם

Rather, it wanted to teach about the laws, that in a Zevina d'Rami Al Apei, the seller benefits, and not the buyer, and in a Zevina Charifa, the buyer benefits, and not the seller, and in an average sale, both of them benefit.

והני מילי כשנמכר שוה בשוה אבל כי נמכר ביותר אפילו זבינא חריפא הנאת מוכר ולא לוקח

(c)

Limitation: This is only when he sells for the proper price. If he sells for more, even in a Zevina Charifa, the seller benefits, and not the buyer;

וכי נמכר בפחות אפילו זבינא דרמי על אפיה הנאת לוקח ולא מוכר

When he sells for less, even in a Zevina d'Rami Al Apei, the buyer benefits, and not the seller.

הדין הוא כללא דשמעתא.

ר"ן ד"ה ואם לאו אני נותן לך לפי טובת הנאה שבהן

Gemara: If not, I will pay you the Tovas Hana'ah of them.

כלומר לפי מה שנהניתי במה שיחזיקו לי טובה כשהן רואים שאני מחזר לשגר להם כלים.

Explanation: How much I benefited, for they have gratitude for me when they see that I strove to send to them Kelim.

ר"ן ד"ה נאנס בהליכה חייב

(b)

Gemara: If Ones occurred on the way, he is liable.

לפי שכל הנאה שלו והיינו סייעתיה דשמואל.

Explanation: This is because all the benefit is his (the buyer's); this supports Shmuel.

ר"ן ד"ה ובחזרה פטור מפני שהוא כנושא שכר

Gemara: If Ones occurred on the way back, he is exempt, since he is like a paid watchman.

ונושא שכר פטור על האונסין ומיהו בגנבה ואבדה חייב כנושא שכר

Explanation: A Shomer Sachar is exempt for Ones. However, he is liable for theft or loss like a Shomer Sachar;

דהא אסיקנא בפרק האומנין שכל שואל לאחר שכלו ימי שאילתו נעשה שומר שכר דהואיל ונהנה מהנה

We conclude in Bava Metzi'a (81a) that every borrower, after the days of his borrowing finish, he is a Shomer Sachar, since [before] he benefited from it.

ומוכח לה התם מהך ברייתא דכיון דבהליכה הוה שואל בחזרה מיהא נהי דלא הוי שואל שומר שכר הוי.

So it is proven there from this Beraisa. Since he is a borrower on the way, after the days of his borrowing finish, he is a Shomer Sachar, since [previously] he benefited from it.

ר"ן ד"ה ההוא ספסירא דשקל חמרא לזבוני בשוקא

(d)

Gemara: A retailer took a donkey to sell in the market.

דרכן של אותן סרסורין היה ליקח בהמה בדמים קצובים והיו מתנים עם הבעלים שאם לא ימצאו לוקחין שיחזירוה להם

Explanation: The norm was that retailers take an animal for a fixed price, and stipulate with the owners that if they will not find buyers, they will return it to them.

והכי מוכח בהדיא בפרק האומנין בהאי עובדא גופיה דמייתי לה התם בלישנא אחרינא.

So it is proven in Bava Metzi'a in this episode itself, which is brought there in the latter version.

ר"ן ד"ה חזרה דספסירא כהליכה היא

Gemara: For a retailer, returning is like on the way.

כלומר כהליכה דמשגר לבית חמיו דמי דהכא נמי בחזרה אי משכח לזבוני מזבין לה.

Explanation: It is like on the way for one who sends to his father-in-law, for here, also on the return, if he finds to sell it, he will sell it.

ר"ן ד"ה מתני'. שאני נהנה לערלים וכו' שאין הערלה קרויה אלא לשם העובדי כוכבים

Mishnah: I will not benefit from Areilim... only Nochrim are called Areilim.

דכולהו אפילו מולים מיקרו ערלים כדכתיב כי כל הגוים ערלים אף על גב דאית בהו מולים.

Explanation: All of them, even circumcised, are called Arelim - "Ki Kol ha'Goyim Arelim", even though some of them are circumcised.

RAN DH v'Omer v'Hayah ha'Plishti ha'Arel [TRANSLATION: And it says "and this uncircumcised Philistine will be...]

ר"ן ד"ה ואומר והיה הפלשתי הערל

(SUMMARY: The Ran explains why all of these verses were needed.)

כלומר דאי מקרא קמא איכא לדחויי דכי קאמר כל הגוים ערלים ערלי לב קאמר והיינו דקאמר סיפיה דקרא דכל בית ישראל ערלי לב כמותם

Explanation: If we had only the first verse, we could reject it, and say that it means that all the Nochrim are Arelim, i.e. Arlei Lev. The end of the verse says that all of Beis Yisrael are Arlei Lev, like them;

מש"ה אמר ואומר והיה הפלשתי הערל הזה דקא קרי ליה דוד ערל אף על גב דלא ידע אי נולד כשהוא מהול

Therefore, it brings another verse "v'Hayah ha'Plishti ha'Arel ha'Zeh." David called him an Arel, even though he did not know whether he was born circumcised.

וכ"ת נולד כשהוא מהול לא שכיחא ואומר פן תעלוזנה בנות הערלים

If you will say that it is not common that one is born circumcised (so David assumed that he was not), it says "Pen Ta'alozna Benos ha'Arelim";

ואי אפשר לעם גדול שלא יהיו בהם כמה אנשים שנולדו כשהם מולים ואפילו הכי אמר בנות הערלים.

In a big nation, it is inevitable that some men were born circumcised, and even so, he said "Benos ha'Arelim."

THE RAN EXPLAINS THE MISHNAH

ר"ן ד"ה ששלש עשרה בריתות נכרתו עליה

(a)

Mishnah: Thirteen covenants were made over it.

שלש עשרה בריתות נכתבו בפרשת מילה.

Explanation: Thirteen times 'Bris' is written in Parshas Milah.

ר"ן ד"ה גדולה מילה שהיא דוחה שבת החמורה

(b)

Mishnah: Circumcision is great. It overrides the severe Isur of Shabbos

דכתיב וביום השמיני ימול ביום ואפילו בשבת.

Explanation: It says "ba'Yom ha'Shemini" - even on Shabbos.

ר"ן ד"ה מלא שעה

(c)

Mishnah: A full hour.

אלא מיד שנתרשל בקש המלאך להורגו.

Explanation: Rather, when he slackened, immediately an angel sought to kill him.

ר"ן ד"ה שהיא דוחה את הנגעים

(d)

Mishnah: It overrides [the Isur of cutting off] Tzara'as.

דכתיב ימול בשר ערלתו ואפילו יש שם בהרת יקוץ.

Explanation: It says "Yimol Besar Orlaso" - even if there is a Baheres (Nega, on the foreskin,) he cuts it off.

ר"ן ד"ה לא נקרא שלם עד שמל

Mishnah: [Avraham] was not called complete until he circumcised.

דכשצוהו על המילה א"ל הקדוש ברוך הוא התהלך לפני והיה תמים.

Explanation: When He commanded him about Milah, Hash-m said "His'halech Lefanai ve'Hye Samim."

ר"ן ד"ה שהיא שקולה כנגד כל המצות שבתורה שנאמר הנה דם הברית

Gemara: It is equal to all the Mitzvos of the Torah, For it says "Hinei Dam ha'Bris.. (The Ran implies that this was in his text of the Mishnah. In our texts, it appears only in the Gemara 32a. - PF)

ואף על גב דהאי דם לאו דם מילה הוא אלא קרבן מ"מ כיון דבתורה כולה כתיב ברית ובמילה נמי כתיב ברית מצותה שקולה כנגד כל המצות.

Even though blood in this verse is not Dam Milah, rather, of a Korban, since "Bris" is written about the entire Torah, and also about Milah it is written "Bris", its Mitzvah is equal to all the Mitzvos.

ר"ן ד"ה גמ' אמול ואצא סכנה היא

Gemara: If I will circumcise [my son] and go [to Egypt], it is dangerous.

אם ילך בדרך תוך ג' ימים דכל ג' ימים כאיב ליה

Explanation: If he will go on the road within three days [it is dangerous], for all three days [one who circumcised] is in pain.

RAN DH di'Chsiv va'Yhi ba'Yom ha'Shelishi bi'Hyosam Ko'avim [TRANSLATION: For it is written, "and it was on the third day, when they were in pain."]

ר"ן ד"ה דכתיב ויהי ביום השלישי בהיותם כואבים

(SUMMARY: The Ran discusses what we learn from the verse.)

ולאו למימרא דביום השלישי כאיב ליה טפי מיומא קמא

(a)

Suggestion: It is more painful on the third day than on the first day!

אלא לכך המתינו שמעון ולוי עד יום השלישי כדי שיהו חלושין ביותר שנכאבו ג' ימים

(b)

Rejection: (This is not so.) Rather, Shimon and Levi waited until the third day [to kill Anshei Shchem] in order that they will be weakest, for they have been in pain three days.

והכי מוכח בפ' ר"א דמילה (שבת קלד:).

(c)

Support: It is proven like this in Shabbos (134b).
