TOSFOS DH Halachah k'R. Yochanan ben Brokah

(SUMMARY: Tosfos explains that this is only for someone who in any case inherits part.)

(a)

Explanation: It seems that this refers only to a son among sons, or a daughter among daughters, like the Rashbam explained.

2)

TOSFOS DH Hai mi'Lo Yuchal Levaker Nafka

(SUMMARY: Tosfos points out another possible response to Abaye's question.)

(a)

Explanation: [Abaye asks] since the Torah said that [a father] cannot change Chelek Bechorah, this implies that he can change the Pashut portion. Why do we need the verse "b'Yom Hanchilu Es Banav"?

(b)

Observation: [Rava] could have said, according to you (Abaye), you should challenge also Rabanan. Why can't he change the Pashut portion? Since it says "Lo Yuchal Levaker", this implies that he can [change] the Pashut portion!

TOSFOS DH she'Yachol

(SUMMARY: Tosfos rejects an alternative text.)

(a)

Assertion: The text does not say "ha'Lo Din Hu" (which connotes that we should say so).

TOSFOS DH Talmud Lomar Lo Yuchal Levaker

(SUMMARY: Tosfos explains why both verses are needed.)

(a)

Question #1: According to Rabanan, why do we need Lo Yuchal Levaker? What would be a source that he can change Chelek Bechorah, that we need a verse to exclude this?

(b)

Question #2: According to R. Yochanan ben Brokah, why do we need "b'Yom Hanchilu"?

1.

Implied Suggestion: We would have learned from a Kal v'Chomer [from Chelek Bechorah] that one cannot change the Pashut portion.

2.

Rejection: If so, the Torah should have omitted Lo Yuchal Levaker, and automatically we would know that one cannot change Chelek Bechorah or the Pashut portion, for this is a stipulation against Torah!

3.

Consequence: If so, you are forced to say that Lo Yevaker (i.e. Lo Yuchal Levaker) is needed only to exclude the Pashut portion (he can change it)!

(c)

Answer: If not for Lo Yevaker, one might have thought that he can change Chelek Bechorah, because it is weaker. [The Bechor] does not receive it from Ra'uy.

(d)

Support: Now we properly need "b'Yom Hanchilu" for R. Yochanan ben Brokah, lest we learn the Pashut portion from a Kal v'Chomer from Chelek Bechorah, which he cannot change.

5)

TOSFOS DH she'Harei Chotchah mi'Kan

(SUMMARY: Tosfos explains that this refers to places in the spleen.)

(a)

Explanation #1 (Rashbam): If one cuts [an animal] here, it can live, i.e. above Tzomes ha'Gidin (the junction of sinews, above the knee).

(b)

Rebuttal: In Chulin (76a) it says about Tzomes ha'Gidin itself, [do not be astounded that a cut in Tzomes ha'Gidin makes it Tereifah, but a cut above does not, for we cannot compare Tereifos.] A proof is that if one cuts here, it can live... (i.e. these words refer to a place other than Tzomes ha'Gidin)!

(c)

Explanation #2: Rather, it refers to the spleen. We hold that if the top of the spleen is punctured, it is Tereifah. If the bottom of the spleen is punctured, it is Kosher.
