Explanation (cont.): This is because due to his vow, he picks this animal that he brings;

Bechor is different. It is Kodesh from when it left its mother's womb, and one cannot switch it with another.

We hold that he is Matfis in Heter, since we conclude in Nazir (21a) that [if Reuven accepted Nezirus, and Shimon said "also I", and Levi said "also I"], he is Matfis in the last (Shimon), and not in the first (Reuven), whether this is a leniency or stringency.

דהא משום דאמרינן דבסיפא מתפיס קתני התם הותר האמצעי הימנו ולמעלה אסור הימנו ולמטה מותר

Source: Because we say that he is Matfis in the last, it teaches there that if the middle one permitted [his Nezirus], those before him are forbidden, and those after him are permitted [because they accepted to be like him];

Version #2: Some texts say "here he said l'Imra", i.e. with a Sheva under the Lamed. Here he said la'Imra", i.e. with a Patach under the Lamed;

Those who have this text hold that with a Patach under the Lamed, it is like "Lo", like the second explanation I wrote above (11b) about the Beraisa "Chulin, ha'Chulin, k'Chulin."

וברייתא הכי תני פעמים דבאומר שאוכל לך אף על גב דמשמע היתר אסור והיינו בלמ"ד שבאית

[Our] Beraisa teaches as follows. Sometimes, when he says "she'Ochel Lecha", even though it connotes Heter, he is forbidden. This is when there is a Sheva under the Lamed.

וההיא דלקרבן לא אוכל לך רבי מאיר אוסר היינו בלמ"ד שבאית

The Mishnah in which R. Meir says that "l'Korban Lo Ochel Lecha", he is forbidden, is when there is a Sheva under the Lamed.

Sometimes, when he says "Lo Ochel Lecha", even though it connotes Isur, he is permitted. This is with a Patach under the Lamed, or if he explicitly says "Lo", based on the different texts.

ר"ן ד"ה מתני'. האומר קרבן עולה וכו' שאני אוכל לך אסור

(a)

Mishnah: If one said "Korban", "Olah"... "that I eat of yours," he is forbidden.

ואף על גב דלא אמר בהו כ"ף הדמיון

Explanation: This is even though he did not say with the Kaf of comparison.

ורבי יהודה מתיר דסד"א דכיון דהני שמן מורה על איסורן להוי כפגול נותר דמודה בהו רבי יהודה דלא בעיא כ"ף

R. Yehudah permits. One might have thought that since all these names teach about their Isurim, [what he wants to forbid] should be like Pigul or Nosar; R. Yehudah agrees that they do not need a Kaf;

קמ"ל וכמו שפרשתי למעלה /נדרים/ (דף יא ד"ה טהור).

The Mishnah teaches that this is not so, like I explained above (11a DH Tahor).

Explanation: All of these expressions connote that what I eat will be a Korban.

Distinction: This is only when he said she'Ochel. However, if he said "Korban Lo Ochel Lecha", he is permitted;

Source: A Mishnah below (15b) says "Korban Lo Ochel Lecha, he is permitted", and we establish it like R. Meir.

The reason is because when he says Korban without a Lamed, this connotes that he swore in the life of the Korban (which has no effect) that he will not eat.

Explanation: The Gemara explains that he means "it will be a Korban. Therefore, I will not eat from you."

וה"ה דאי אמר לקרבן שאוכל לך אסור דמשמע שפיר לקרבן יהא מה שאוכל משלך

The same applies if he said "l'Korban she'Ochel Lecha", he is forbidden. This properly connotes "it will be a Korban what I eat from you."

Implied question: Why wasn't this taught together with the expressions in the Reisha? It should have taught "ha'Korban k'Korban Korban l'Korban she'Ochel Lecha", Asur"!

משום דהנהו תלתא דהיינו הקרבן כקרבן קרבן דוקא כי אמר שאוכל אסור אבל אמר לא אוכל שרי וכדכתיבנא

Answer: It is because these three, i.e. ha'Korban k'Korban Korban, only when he says she'Ochel Lecha, he is forbidden. However, if he said Lo Ochel, he is permitted, like I wrote;

אבל כי אמר לקרבן אפילו אמר לא אוכל אסור.

However, when he said "l'Korban", even if he said Lo Ochel, he is forbidden.

Gemara: Nedarim take effect on a Mitzvah.

בפ"ב (לקמן דף טז:) מוכחינן לה מקרא שהשבועות חלות על דבר שאין בו ממש משום דמיתסר גברא הוא שלא יעשה כן ואיהו אית ביה ממש.

Explanation: Below (16b) we prove from a verse that Shevu'os takes effect on something intangible, because the person is forbidden to do so, and he is tangible.

Gemara: This does not apply to Nedarim.

דמתסר חפצא הוא הילכך אי לית ביה מששא לא אסר מידי.

Explanation: The object is forbidden. Therefore, if it is intangible, he did not forbid anything.

RAN DH b'Omer Ye'aser Pi l'Diburi [TRANSLATION: When he says 'my mouth is forbidden for my speech.']

Explanation: It is as if he said this, for he said 'Konam Pi Medaber' - this implies that the Konam applies to [his] speech, and it implies that that it applies to his mouth;

Therefore, since we are stringent about Stam Nedarim, we say that it applies to his mouth, and his mouth is tangible.

Support: We find like this in the Gemara. We say "he says", and it means that it is considered as if he said.

Explanation: The Mishnah lists all kinds of Isurim. It lists Isurei Achilah, such as pork, and Isurei Hana'ah, like idolatry;

ואסורין בהנאה שאין להם בטלה כעורות לבובין שהיו תקרובת לעבודת כוכבים שהיו נוקבין העור כנגד הלב והיו מוציאין אותו כשהוא חי

It lists Isurei Hana'ah that cannot be Batel, such as Oros Levuvin, which were offered to idolatry. They make a hole in the skin to remove the heart in the animal's lifetime;

וחמירי מעבודת כוכבים דנהי דעבודת כוכבים אית לה בטלה תקרובת עבודת כוכבים אין לה בטלה

This is more stringent than idolatry. Idolatry can be Batel, but something offered to idolatry cannot be Batel.

ותנא נמי שאסורין באכילה בלבד ויש בהן טומאה כנבילות ושטומאתן חמורה בכעדשה כשקצים ורמשים.

Explanation (cont.): It teaches also Isurei Achilah alone (without Isur Hana'ah) that have Tum'ah, such as Neveilos, and Isurim whose Tum'ah is stringent, that the size of a lentil is Metamei, such as vermin.

RAN DH k'Chalas Aharon vechi'Terumaso [TRANSLATION: Like the Chalah of Aharon and like his Terumah.]

Explanation: Even though there is an Isur through Keri'as Shem (declaring it to be Chalah or Terumah), this is not called Davar ha'Nadur, like I wrote above (12a DH b'Ikaro, DH k'Chalas);

Even though it is forbidden to some and permitted to others, this is not due to his vow, for when he separated it, he did not specify [to whom it should be forbidden];

אלא ודאי מאי דאסירי לזרים מחמת אסורא הוא דרמא רחמנא עלייהו

Rather, surely the Isur to Zarim is because the Torah imposed an Isur on them.

וטעמא דכולהו הני דאין מתפיסין בהן משום דבעינן שיתפיס בדבר הנדור ולא בדבר האסור כדאיתא בגמרא.

The reason for all of them in which one cannot be Matfis is because we require Hatfasah in Davar ha'Nadur, and not in Davar ha'Asur, like it says in the Gemara.

Explanation: Even an Am ha'Aretz who vowed with one of these does not need a Pesach. Rather, he is permitted automatically;

ולהכי אף על גב דפתח ותנא ואלו מותרין הדר ותנא הרי זה מותר משום דקא בעי למיתנא האומר לאשתו הרי את עלי כאימא דצריך פתח בעם הארץ וכדאיתא בגמרא

Therefore, even though he began and taught "these are permitted", he repeated "he is permitted", because he needed to teach "one who says to his wife 'you are Alai like mother', he needs a Pesach" if he is an Am ha'Aretz, like it says in the Gemara;

ואי לא הדר ותנא הרי זה מותר לא ידענא ואלו מותרין דרישא כלומר שהן מותרין בלא פתח אהי מינייהו קאי אי אכולהו אי אתרתי מינייהו.

Had he not repeated "he is permitted", we would not know about "these are permitted" of the Reisha, i.e. that they are permitted without a Pesach - to which this refers? I.e. does it refer to all of them, or to two of them?

RAN DH ha'Omer l'Ishto v'Chulei [TRANSLATION: One who says to his wife...]

Implied question: Why did it mention "you are Alai like mother?" The same applies if he was Matfis with other Isurei Hana'ah, such as idolatry, Orlah or Kil'ai ha'Kerem!

Note: Why did he say 'other Isurei Hana'ah'? Only Bi'ah with his mother is Asur, but not Hana'ah! (PF)

Also the Beraisa in the Gemara teaches "you are Alai like the flesh of mother, like the flesh of my sister, like Orlah or Kil'ai ha'Kerem"!

Answer: It mentioned like mother, for this is one case that teaches two. Firstly, it teaches that even though he is Matfis with Davar ha'Asur, mid'Rabanan an Am ha'Aretz needs a Pesach;

ואשמעינן תו דצריך שיהא ממקום אחר אבל אין פותחין לו בכבוד אמו כלומר אילו היית יודע שלא יהא כבוד לאמך בכך לא היית נודר

It teaches also that [the Pesach] must be from elsewhere. We do not make a Pesach based on his mother's honor, i.e. "had you known that this will not be honorable for your mother, you would not have vowed."

דלא תימא נהי דאין פותחין לו לאדם בכבוד אביו ואמו ה"מ בנדרים דאורייתא אבל האי דליתיה אלא מדרבנן פותחים קא משמע לן דלא, הרשב"א ז"ל,

One might have thought that we do not make a Pesach for a man based on his father's or mother's honor, i.e. for Torah Nedarim, but mid'Rabanan, we make a Pesach [based on their honor] mid'Rabanan. [Like mother] teaches that this is not so. The Rashba said so.

ודוקא במדיר אשתו ומתפיס בדבר האסור צריך פתח מפני שדרכו לאסור את אשתו מתוך הקפדה

Limitation: This is only if one was Madir his wife, and was Matfis in Davar ha'Asur, he needs a Pesach, because it is common to forbid one's wife amidst being upset;

ואי שרית ליה בלא פתח כי מתפיס בדבר האסור אתי למישרי נמי אפילו מתפיס בדבר הנדור

If we permit him without a Pesach when he is Matfis in Davar ha'Asur, he will come to permit even when he is Matfis in Davar ha'Nadur.

אבל שאר נדרים מתוך שאין מצויין כל כך לא גזרו בהן ואין צריכין שאלה

However, other Nedarim, since they are not so common, they did not decree about them. One need not ask [a Chacham to permit them].

והיינו דנדרים דרישא דמתניתין מותרין לגמרי כדאיתא בגמרא.

These are the Nedarim of the Reisha of our Mishnah. They are totally permitted, like it says in the Gemara.

Explanation: Surely Chulin was not taught for it itself, for obviously it is permitted! Rather, it was for an inference, that 'la'Chulin' is forbidden.
