SUMMARY

1. Rebbi Elazar explains why the new year of fruits is in Shevat.
 
2. Rebbi Akiva picked an Esrog on the first of Shevat, and separated Ma'aser from it twice.
 
3. There is a dispute about whether an Esrog has the status of a fruit or a vegetable.
 
4. The Gemara concludes that Rebbi Akiva was not trying to abide by both the opinions of Beis Shamai and Beis Hillel.
 
5. The Gemara suggests that Raban Gamliel must maintain that an Esrog is like a vegetable not just for one law, but for two laws.

A BIT MORE

1. This is because most of the rain has already fallen, causing the trees to be able to blossom, and yet most of Tekufas Teves (the winter period) has not passed.
 
2. The Tana Kama explains that Rebbi Akiva was unsure about whether the law follows Beis Shamai or Beis Hillel. Therefore, out of doubt, he separated the appropriate Ma'aser for the new year according to Beis Shamai, and he separated Ma'aser as if it was a fruit from the previous year according to Beis Hillel.
 
3. Raban Gamliel: It has the status of a fruit, except for the fact that its new year is determined by its time of harvest. Rebbi Eliezer: An Esrog has all the laws of a fruit.
 
4. Rather, he always acted based on the rulings of Beis Hillel. In this situation, he simply forgot whether Beis Hillel had said the new year was the first of Shevat or the fifteenth of Shevat.
 
5. If he says that its new year is determined based on when it is harvested (as is the law of a vegetable), then its new year must be the first of Tishrei.
