KERISUS 19 (9 Elul) - Dedicated to commemorate the Yahrzeit of  Chana bas Mordechai Eliezer z'l.

SUMMARY

1. The Gemara discusses the case of a person who accidentally entered the Beis ha'Mikdash after walking on two paths, one Tahor and one Tamei.
 
2. The Gemara similarly discusses the case of a person who entered the Beis ha'Mikdash after he walked on the first path and purified himself, and then he walked on the second path and entered the Beis ha'Mikdash again.
 
3. The Mishnah discusses the case of a person who transgressed one of two prohibitions that were in front of him, but he is unsure about which one.
 
4. The Gemara explains Rebbi Yehoshua's reasoning.
 

 
5. If one performs an action that he did not intend to do (for example, he ate Chelev when in fact he reached for a piece of permitted meat), he still is obligated to bring a Korban Chatas.

A BIT MORE

1. The Tana Kama and Rebbi Shimon: He is liable for entering the Beis ha'Mikdash while Tamei, since he certainly was Tamei when he entered, and he must bring a Korban. Rebbi Shimon ben Yehudah: He is not obligated to bring a Korban if he forgot that he walked on both paths when he entered the Beis ha'Mikdash, even though he certainly was Tamei.
 
2. Tana Kama: He is obligated to bring a Korban. Rebbi Shimon and Rebbi Shimon ben Yehudah: He is exempt, because each time he entered the Beis ha'Mikdash he was unsure about whether he was Tahor; that is, he did not have enough previous knowledge to make him liable to offer such a Korban.
 
3. Rebbi Eliezer: He is liable, since both prohibitions make one liable to bring a Chatas. Rebbi Yehoshua: He is exempt. Rebbi Yehudah says that Rebbi Yehoshua maintains that he is exempt even from bringing an Asham Taluy.
 
4. He derives this from the verse, "that he sinned with it," implying that he must know which sin he committed in order to be obligated to bring a Chatas.
 
5. A person who has pleasure from a sin is always liable, even if he not only did not intend to sin, but did not intend to do the action of the sin (for example, he thought he was picking up Kosher meat, and by mistake he picked up the non-Kosher meat next to it).
