MENACHOS 47 (21 Nisan) - dedicated by Mr. Michael Missry in memory of his brother, Joseph M. (Yosef ben Arlene) Missry.

SUMMARY

1. If the Shechitah and Zerikah of the two Kivsei Atzeres were done Lishmah, the two breads become sanctified. If the Shechitah was done Lishmah, but not the Zerikah, according to Rebbi the breads become partially sanctified. Rebbi Elazar b'Rebbi Shimon disagrees.
 
2. Everyone agrees that if the breads were not in existence at the time of the Shechitah of the Kivsei Atzeres, they do not become sanctified, even if they existed at the time of the Zerikah.
 
3. If the two breads were taken out of the Azarah after the Shechitah of the Kivsei Atzeres, and the Zerikah was then done with a Machshavas Pigul, according to Rebbi Eliezer one who eats the bread is not Chayav Kares. Rebbi Akiva disagrees.
 
4. If Eimurim of Kodshim Kalim were taken out of the Azarah before the Zerikah was performed, according to Rebbi Eliezer there is no Chiyuv Me'ilah for the Eimurim, and there is no Chiyuv of Pigul, Nosar, or Tamei. Rebbi Akiva disagrees.
 
5. There is a doubt about whether Rebbi Akiva, who says that a Zerikas Pigul renders the two breads Pigul even when they left the Azarah, maintains that Zerikah she'Lo Lishmah permits the Kohanim to eat the two breads.
 
6. If, after the Shechitah of the two Kivsei Atzeres, the two breads were lost, the flesh of the Korban may not be eaten, regardless of whether the Zerikah was done Lishmah or she'Lo Lishmah.
 
7. A Korban Pesach offered she'Lo Lishmah before or after the afternoon of Erev Pesach is valid. If it is brought Lishmah at those times, it is Pasul.
 
8. If the Kivsei Atzeres were slaughtered with four breads, the Kohen must take two of the breads and perform Tenufah with them together with the Kevasim.

A BIT MORE

1. According to Rebbi, the breads are only partially sanctified and may not be eaten by the Kohanim. Abaye says that if the two breads are redeemed, the redemption is valid even according to Rebbi, because the two breads do not attain Kedushas ha'Guf and therefore may be redeemed like any item of Kedushas Damim. Rebbi says that the breads are partially sanctified only with regard to becoming Pasul if taken out of the Azarah. Rava says that the two breads do attain Kedushas ha'Guf and may not be redeemed. Rava and Abaye agree that the two breads may not be eaten by the Kohanim.
 
2. Even according to Rebbi Elazar b'Rebbi Shimon, who maintains that the Zerikah is the primary Avodah which sanctifies the two breads, the breads must be in existence at the time of the Shechitah. If they exist only at the time of the Zerikah, they are not sanctified by the Zerikah.
 
3. Rebbi Eliezer maintains that Zerikah does not affect the status of something that became Pasul with Yotzei. Therefore, the Machshavas Pigul does not make the breads Pigul. Rebbi Akiva rules that Zerikah does affect the status of something that was Yotzei. Therefore, the Machshavas Pigul renders the two breads Pigul, and one who eats the bread is Chayav Kares.
 
4. There is no Chiyuv Me'ilah for Kodshim Kalim, except for Me'ilah with the Eimurim after the Zerikah. According to Rebbi Eliezer, if the Eimurim were taken out of the Azarah before the Zerikah, the Zerikah does not affect the status of the Eimurim and there is no Chiyuv Me'ilah. Similarly, there is no Chiyuv for Pigul, Nosar, or Tamei. According to Rebbi Akiva, the Zerikah does affect the status of the Eimurim, and there is a Chiyuv for Me'ilah, and the Chiyuvim of Pigul, Nosar, and Tamei apply.
 
5. If Rebbi Akiva agrees with Rebbi that Shechitah Lishmah partially sanctifies the two breads, then perhaps Zerikah she'Lo Lishmah permits the breads to be eaten, since Rebbi Akiva says that a Zerikas Pigul renders the two breads Pigul just as it renders the flesh of the Korban Pigul. Perhaps Rebbi Akiva also maintains that Zerikah she'Lo Lishmah permits the two breads to be eaten just as it permits the flesh of the Korban to be eaten.
 
6. If the Zerikah was done Lishmah, the flesh of the Korban may not be eaten, because if the breads were in existence at the time of the Shechitah and subsequently were lost, the Kevasim may no longer be offered. Even if the Zerikah is done l'Shem Shelamim, it is Pasul, because a Korban which was originally fit to be offered Lishmah and became invalidated from being offered Lishmah after Shechitah is also Pasul if it is offered she'Lo Lishmah.
 
7. A Korban Pesach brought any time other than on the afternoon of the fourteenth of Nisan is a Shelamim, not a Pesach.
 
8. The Kivsei Atzeres require Tenufah both while they are alive and after they are slaughtered.
