12TH CYCLE DEDICATIONS:

ERUVIN 90 (3 Teves) - the Dafyomi material for today has been dedicated in memory of Hagaon Rav Yisroel Zev Gustman Ztz"L (author of "Kuntresei Shiurim") and his wife, Rebbetzin Sarah Gustman (daughter of Hagaon Rav Meir Bassin, a Dayan in Vilna) in honor of the day of the Yahrzeit of the Rebbetzin. Sponsored by a number of Rav Gustman's Talmidim (Yechiel Wachtel, Michael Starr and Mordecai Kornfeld).

SUMMARY

1. Rav rules that one clearly may not carry (see Daf 89) from a roof to a tall pole that is in the public domain.

2. It is unclear whether the Rabanan allow carrying from one person's roof to another person's porch.

3. Rav agrees that if there are walls that are visible on the roof, one may carry on the entire roof.

4. There is a dispute about whether one may carry on a boat on Shabbos.

5. Shmuel himself ruled that the law follows Rav in the case of carrying on a boat.

A BIT MORE

1. Even if the pole is ten Tefachim tall and four Tefachim wide, the roof is considered a Karmelis and the pole is considered a Reshus ha'Yachid. Carrying from a Karmelis to a Reshus ha'Yachid is always forbidden (mid'Rabanan).

2. If the porch is not on top of a house, the adjacent roof and the porch do not have the appearance of being two separate domains, and perhaps the Rabanan would permit carrying from the roof to the porch. Only when there is a house below the porch would the Rabanan prohibit carrying from the roof to the porch (since just as the domains beneath them are two separate domains, the roof and the porch have the status of two separate domains).

3. He forbids carrying on the entire roof only when the walls are not apparent. The same criterion applies, according to Rav, in the case of carrying from one roof to another roof (of similar height) according to Rebbi Meir.

4. Rav: One may carry anywhere within the boat, as the walls of the boat are made for people to live within them. Shmuel: One may carry only four Amos at a time, as the walls are made to keep out the water, not for living inside of them.

5. Rav agrees that one may not carry feely within an overturned boat that is being tarred, because the entire time that it is in this position its walls are not meant for people to live within them.
