|AVODAH ZARAH 48 - Dedicated by Harav Gedaliah Weinberger shlit'a in memory of his father, Reb Chaim Tzvi ben Reb Shlomo Weinberger, whose Yahrzeit is 18 Adar. Reb Chaim Tzvi, a Holocaust survivor who raised his family in a new country, bequeathed his children a steadfast commitment to Torah and its study.|
1. If a tree is planted with intent to worship it as an Avodah Zarah, it is forbidden.
2. If a tree was cut down or carved in order to worship it as an Avodah Zarah, the tree becomes permitted by removing the new growth.
3. If a branch of one tree was grafted onto another tree in order to worship it as an Avodah Zarah, the tree becomes permitted by removing the new growth.
4. Shmuel maintains that if a tree was not planted to be worshipped as an Avodah Zarah but later it was worshipped, the growth of the tree is forbidden.
5. According to the Tana Kama, any tree under which an Avodah Zarah rests is an Asheirah tree. Rebbi Shimon disagrees.
6. According to Rav, if the priests of the Avodah Zarah sit under a tree but do not taste its fruit, the tree is assumed to be an Asheirah.
7. According to Shmuel, even if the fruit of a tree is reserved for the production of beer for the Avodah Zarah, the tree is assumed to be an Asheirah.
8. It is forbidden to sit in the shade of an Asheirah.
9. A person who walks under the branches of an Asheirah becomes Tamei.
10. When the branches of an Asheirah protrude into a public domain, one is permitted to pass underneath the branches if there is no other way to go.
11. According to the Tana Kama, one is permitted to plant vegetables under an Asheirah tree in the winter but not in the summer. Lettuce may not be planted under an Asheirah tree even in the winter.
12. Rebbi Yosi says that vegetables may not be planted under an Asheirah tree even in the winter. The leaves that fall off the tree fertilize the vegetables.
13. Rebbi Yosi says that one is permitted to plant a branch from a tree of Orlah, but not a fruit from a tree of Orlah.
A BIT MORE
1. It remains forbidden until a Nochri is Mevatel the Avodah Zarah.
2. The idolater's intention was to worship only the new growth. Therefore, only the new growth is prohibited.
3. Even though an action was done to the tree, only the new growth is forbidden and not the original part of the tree.
4. It is a Safek whether Shmuel's ruling is in accordance only with the view of Rebbi Yosi bar Yehudah, but the Rabanan permit the growth of the tree, or whether it is in accordance with both the Rabanan and Rebbi Yosi bar Yehudah.
5. According to Rebbi Shimon, a tree is an Asheirah only when the tree itself is worshipped. If an Avodah Zarah underneath the tree is worshipped, the tree is not an Asheirah.
6. Since they refuse to partake of the fruit, it is apparent that they worship the tree.
7. Shmuel agrees that if the priests of Avodah Zarah sit underneath a tree and do not partake of the fruit, it is an Asheirah. He adds that if the fruit is reserved for making beer for the Avodah Zarah, it is also an Asheirah.
8. It is forbidden even to sit in the long shade of the tree, even though it does not provide protection from the sun.
9. This is in accordance with Rebbi Yehudah ben Beseirah who says that something which is offered as a sacrifice to an Avodah Zarah is Metamei b'Ohel. It is inevitable that an Avodah Zarah is underneath the tree.
10. The Tum'ah of an Avodah Zarah is a Gezeirah d'Rabanan. The Gezeirah does not apply when the branches protrude into a public domain.
11. The shade of a tree is beneficial for vegetables in the summer but not in the winter. For lettuce, however, the shade is beneficial even in the winter.
12. The Tana Kama agrees that the leaves benefit the vegetables. However, the detriment of the shade outweighs the benefit of the fertilizer.
13. Rebbi Yosi agrees that if, b'Dieved, a fruit of a tree of Orlah is planted, the fruit which is produced by the tree is permitted.
