SUMMARY

1. The Rabanan prohibited eating oil of a Nochri.
 
2. Rebbi Yehudah Nesi'ah and his Beis Din accepted the prohibition against buying oil from a Nochri.
 
3. A Beis Din does not have the authority to nullify a decree of another Beis Din unless it is greater in wisdom and in number.
 
4. The Rabanan may not institute a decree unless the majority of Klal Yisrael is capable of upholding it.
 
5. Rav Nachman bar Yitzchak maintains that the Rabanan decreed that Nochriyos have the status of a Nidah from birth.
 
6. Rebbi Yitzchak maintains that the Rabanan prohibited Yichud with a Nochris because of the concern that it can lead to Avodah Zarah.
 
7. There is a disagreement about whether the Torah prohibits intermarriage with all Nochriyos or only with women from the seven nations.

A BIT MORE

1. According to Rav, the decree was instituted by Daniel because of the concern that if the oil was brought from Nochrim in the city, it could lead to intermarriage. Shamai and Hilel decreed that it is forbidden even if it is bought in the fields. Shmuel maintains that Daniel did not institute the decree. Rather, the decree was instituted by the Rabanan because of the concern that the oil was cooked in non-kosher pots.
 
2. According to Rav, Rebbi Yehudah Nesi'ah permitted it because the decree made by Shamai and Hillel never took hold among the majority of Klal Yisrael. According to Shmuel, Rebbi Yehudah Nesi'ah and his Beis Din permitted oil bought from a Nochri because if the oil was cooked in non-kosher pots, it received a bad taste from what was absorbed in the pots, and thus it is permitted.
 
3. Even a Beis Din which is greater in wisdom and number may not nullify the eighteen decrees of Shamai and Hillel. Even Eliyahu ha'Navi and his Beis Din may not nullify them.
 
4. If it is found that the majority of Klal Yisrael cannot keep the decree, it may be nullified by another Beis Din, even by one which is of a lesser stature than the Beis Din which made the decree.
 
5. However, Min ha'Torah the blood of a Nochris is not Tamei.
 
6. The Rabanan decreed that Nochri bread and oil is forbidden so that Jews will not drink their wine. The wine of Nochrim is forbidden because it can lead to intermingling and intermarriage, which in turn leads to worshipping Avodah Zarah.
 
7. According to the Rabanan, the prohibition applies only to the seven nations. Rebbi Shimon maintains that it applies to all Nochriyos.
 
8. The zealous may kill him only if the act is committed publicly, and only during the act.
 
9. Even if the act was done in seclusion, he transgresses mid'Rabanan the prohibitions of Nidah, Shifchah, Goiyah, and Zonah. According to a second opinion, he transgresses the prohibition of Eshes Ish, but not the prohibition of Zonah.
 
10. Min ha'Torah, only Yichud with an Eshes Ish is forbidden. The Beis Din of David prohibited even Yichud with an unmarried woman.
 
11. According to Rebbi, a Nochri boy is Tamei from one-day-old. Rebbi Chiya maintains he is Tamei from the age of nine.
