SUMMARY

1. If a person swears not to eat figs and grapes, and then he swears not to eat figs, if he forgets the second Shevu'ah and eats figs and, after designating a Korban, he also eats grapes, he is not Chayav a Korban for the first Shevu'ah.
 
2. If a person swears not to eat ten loaves and then he swears not to eat nine loaves, if, after designating a Korban, he also eats a tenth loaf, he is not Chayav a Korban for the first Shevu'ah.
 
3. If a person swears that an object which is known to be made of stone is made of gold, or that a person known to be a man is a woman, it is a Shevu'as Shav.
 
4. If a person swears that he witnessed an impossible occurrence, or that he will transgress a Mitzvah, it is a Shevu'as Shav.
 
5. If a person swears to eat this loaf of bread, and then he swears not to eat it, the first Shevu'ah is a Shevas Bituy and the second Shevu'ah is a Shevu'as Shav.
 
6. When Beis Din compels someone to swear, they inform him that his Shevu'ah is not based on his own Da'as but rather it is based on the Da'as of Hashem and of Beis Din.
 
7. When Moshe compelled Klal Yisrael to swear that they will not worship Avodah Zarah, he told them that the Shevu'ah is not based on their Da'as but rather on the Da'as of Hashem and the Da'as of Moshe.
 
8. If a person answers "Amen" to a Shevu'ah, he is Chayav.
 
9. Only people who are fit to be witnesses are Chayav a Korban for Shevu'as ha'Edus.
 
10. Rebbi Meir maintains that if a person makes a Shevu'as ha'Edus on his own, he is Chayav even if he swore outside of Beis Din.

A BIT MORE

1. Even though he ate figs and grapes and thereby transgressed his first Shevu'ah, since he designated a Korban before he ate the grapes the grapes are regarded as a half-Shi'ur and he is not Chayav a Korban for the first Shevu'ah.
 
2. Even though he ate a tenth loaf and thereby transgressed his first Shevu'ah, since he designated a Korban after he ate nine loaves when he subsequently ate a tenth loaf it is regarded as a half-Shi'ur and he is not Chayav a Korban for the first Shevu'ah.
 
3. Ula maintains that it is regarded as a Shevu'as Shav only if it is known by three people that the pillar is made of gold, or that the person is a man.
 
4. For example, if he swears that he saw a flying camel, or that he will not wear Tefilin, it is a Shevu'as Shav.
 
5. If he eats the bread, he transgresses the Shevu'as Shav. If he does not eat it, he also transgresses the Shevu'as Bituy.
 
6. The Beis Din makes this condition in order to prevent him from swearing deceptively. For example, if he is accused of owing money, we do not want him to hide the money inside a tube and give the accuser the tube to guard and then swear that he returned the money.
 
7. Moshe Rabeinu made this condition in order to prevent Klal Yisrael from being released from their oath. A person may not be released from an oath which was based on the Da'as of the public.
 
8. Shmuel says that whenever a person answers "Amen" to a Shevu'ah, it is considered as though he uttered the Shevu'ah himself.
 
9. Only men, non-relatives, and people who are eligible to be witnesses are Chayav for swearing falsely that they are not aware of testimony.
 
10. However, if others placed the Shevu'ah on him and he said "Amen," he is Chayav even outside of Beis Din. Otherwise, he is Chayav only in front of Beis Din.
