12TH CYCLE DEDICATIONS:
 
ERUVIN 33 (5 Cheshvan) - Dedicated in honor of the first Yahrzeit of Reb Naftali ben Reb Menachem Bodner ZT"L, an Ish Chesed and Ish Ma'aseh whose Simcha and Ahavas Yisrael knew no bounds. Dedicated by his son Mordechai and family, of Givat Mordechai, Yerushalayim.

SUMMARY

1. The Gemara explains why an Eruv placed at a height of ten Tefachim above ground in a tree is not valid.
 
2. The top of a pole or tree branches that is nine Tefachim high in Reshus ha'Rabim is considered like Reshus ha'Rabim.
 
3. The sages did not forbid using the lowest part of a tree on Shabbos.
 
4. Rebbi Yehudah: An Eruv must be placed on an area that is at least four Tefachim wide.
 
5. Rebbi Yosi b'Rebbi Yehudah understands that even a basket that is four Tefachim wide can serve as such an area (see #4).

A BIT MORE

1. The case is where the person wanted his resting place for Shabbos to be at the base of the tree, but he placed his Eruv four Amos away from the base of the tree, and higher than ten Tefachim from the ground. By doing so, he has caused his Eruv to be inaccessible, since his Eruv is in a Reshus ha'Yachid (ten Tefachim high) that is four Amos away from his desired resting place, a distance which he may not carry the food of the Eruv from its place to his resting place.
 
2. If it is a type of pole or branches that people use to help them load and unload their packages, it is considered part of Reshus ha'Rabim. It can serve as a resting place for an object that one has been carrying.
 
3. Any part of the tree that is less than three Tefachim from the ground may be used on Shabbos, since it is considered like the ground itself.
 
4. This could be on the ground itself, or on top of a pole that is ten Tefachim tall and four Tefachim wide. However, if it is less than four Tefachim wide, the Eruv may not be placed there.
 
5. He considers a basket that is four Tefachim wide, and situated at its midpoint on top of a pole that is less than four Tefach wide, to be a surface of four Tefachim not only for Eruv but also to make the basket a Reshus ha'Yachid. However, the basket is a Reshus ha'Yachid only when the basket is located exactly in the middle of the pole, causing all sides of the basket to be viewed as if they are walls that go down to the ground, creating a domain of four Tefachim wide and ten Tefachim tall.
