BAVA BASRA 95 (25 Elul) – Dedicated in memory of Yechiel Avraham Avigdor ben Eliyahu Glaser z'l, by his father, his brother Yisrael, and family. May Avigdor's children merit to grow in Torah and Yiras Shamayim, and become sources of pride and Nachas to their father in Gan Eden.

SUMMARY

1. The Gemara states the basic laws of Ona'ah (overcharging or underpaying by one sixth more or less than the market value).
 
2. The Gemara discusses the case of a person hired to plant 100 fruit trees for his friend.
 
3. The Gemara discusses when wine is of such poor quality that one no longer recites on it the blessing of Borei Pri ha'Gefen.
 
4. Rav Chisda argues that whenever wine smells like vinegar, even if it tastes like wine, the blessing is Shehakol.
 
5. The blessing on bread that became moldy, or on a cooked dish that turned sour, is Shehakol.

A BIT MORE

1. If a person sells an item for less than one sixth more than its market value, the buyer has no recourse. If he sells it for exactly one sixth more, the sale is valid, but the sixth must be returned to the purchaser. If he sells it for more than one sixth of the market value, the sale is invalid.
 
2. If up to 10 trees do not end up yielding fruit, this is considered normal, and the person who was hired does not have to pay back anything. If more than 10 trees do not bear fruit, he must replace all of the non-fruit-bearing trees, including the first 10.
 
3. Rav Yehudah maintains that as long as it is still sold in any store as wine, its blessing is Borei Pri ha'Gefen. However, he agrees that if it is sold on a street corner (Rashbam) or its appearance has changed from the normal appearance of wine, its blessing is Shehakol.
 
4. Rav Yehudah seems to argue with Rav Chisda's opinion. (The Gemara discusses this case at length on Daf 96.)
 
5. Although they still provide sustenance and thus deserve a blessing of Shehakol, they do not deserve the specific blessing of Hamotzi or any other specific blessing when they are no longer in a desirable state.
