SUMMARY

1. One may be Makdish an animal on the night going into the eighth day of its life, but he may not offer it as a Korban until the eighth day.

2. According to the Rabanan, if one slaughters a mother and son of Kodshim outside the Azarah on the same day, there is a Chiyuv Kares for the first Shechitah and a Chiyuv Lav for the second Shechitah. He is Chayav Malkus for both.

3. According to Rebbi Shimon, there is Chiyuv Kares for both the first and second Shechitos.

4. According to the Rabanan, if one slaughters a mother of Kodshim outside the Azarah and the son of Kodshim inside the Azarah, he is Chayav Kares for the first Shechitah, and the second Shechitah is Pasul. Rebbi Shimon maintains that the second Shechitah is valid.

5. According to the Rabanan, if one slaughters a mother of Kodshim inside the Azarah and the son of Kodshim outside the Azarah, the first Shechitah is valid, and the second Shechitah is Pasul, and the person is Patur from punishment. Rebbi Shimon maintains that there is a Chiyuv Lav for the second Shechitah.

6. Rava maintains that according to Rebbi Shimon, if one slaughters a mother of Chulin and its son as a Shelamim on the same day, he is exempt from Malkus.

7. Rava maintains that according to Rebbi Shimon, if one slaughters a mother as a Shelamim and the son of Chulin on the same day, he is Chayav, but if the mother was an Olah he is exempt.

8. According to Rebbi Yochanan, even if the mother is an Olah, one is Chayav for slaughtering the son of Chulin on the same day.

9. One slaughters a mother animal and finds that it is a Tereifah, or he slaughters it for Avodah Zarah, or it was a Shor ha'Niskal. He subsequently slaughters its son on the same day. According to Rebbi Shimon, he is exempt. The Chachamim disagree.

10. If one slaughters a mother animal and subsequently slaughters its son for Avodah Zarah, he is not punished for transgressing the prohibition against slaughtering a mother and its son on the same day, even if he did not receive Hasra'ah for the prohibition of Avodah Zarah, according to Reish Lakish. Rebbi Yochanan disagrees.

11. If one unintentionally transgresses a sin for which there is a Chayav Misah or Malkus when transgressed intentionally, he is exempt from any accompanying Chiyuv Mamon, according to Reish Lakish. Rebbi Yochanan disagrees.

A BIT MORE

1. One who offers an animal as a Korban in the first seven days of its life is Chayav Malkus.

2. There is no Chiyuv Kares for Shechutei Chutz for the second Shechitah, since it is not fit to be brought on the Mizbe'ach because of the prohibition against slaughtering the son on the same day as its mother.

3. Rebbi Shimon maintains that a Shechitah which does not permit the animal to be eaten is not considered a Shechitah. Therefore, the Shechitah of the first Korban was not a Shechitah at all and the prohibition against slaughtering a son on the same day as its mother does not apply. Since it is fit to be brought on the Mizbe'ach, there is a Chiyuv Kares for Shechutei Chutz.

4. According to the Rabanan, the Shechitah is Pasul because the animal is not fit to be brought as a Korban because of the prohibition against slaughtering a son on the same day as its mother. According to Rebbi Shimon, the prohibition does not apply, because the first Shechitah is not considered a Shechitah since it was Pasul.

5. According to the Rabanan, since the second Korban is not fit to be brought inside the Azarah because of the prohibition against slaughtering a son on the same day as its mother, there is no Chiyuv for Shechutei Chutz. According to Rebbi Shimon, even though the second Korban is not fit to be brought today as a Korban, since it will be fit to be brought tomorrow there is a Chiyuv Lav for Shechutei Chutz, but not a Chiyuv Kares.

6. Rava maintains that according to Rebbi Shimon, the Hasra'ah that is given for the prohibition against slaughtering a mother and son of Kodshim on the same day is a Hasra'as Safek, because the Korban is not fit to be eaten until the Zerikas ha'Dam. Since the Hasra'ah must be given at the time of the Shechitah, and at that moment there is an uncertainty about whether it is a Shechitah Re'uyah because the Shechitah depends on the Zerikas ha'Dam, it is a Hasra'as Safek.

7. The Shechitah of an Olah is not considered a Shechitah, according to Rebbi Shimon, because an Olah is not eaten at all.

8. Rebbi Yochanan maintains that although an Olah is not eaten, it is consumed by the Mizbe'ach, and this is regarded as an Achilah. Therefore, it is considered a Shechitah even according to Rebbi Shimon.

9. According to Rebbi Shimon, any Shechitah which does not allow the meat of the animal to be eaten is not considered a Shechitah.

10. According to Reish Lakish, since he would have been Chayav Misah for Avodah Zarah had he received Hasra'ah, he is exempt from Malkus even though he did not receive Hasra'ah. According to Rebbi Yochanan, since he is not Chayav Misah, he is Chayav Malkus.

11. According to Reish Lakish, one is exempt even from a Chiyuv Mamon if it is accompanied by a Chiyuv Malkus or Chiyuv Misah, even if he acted b'Shogeg and is not punished with Misah or Malkus. Rebbi Yochanan disagrees.
