Question

SUMMARY

If a Kohen went overseas after his marriage and returned with his wife and children if the children are clinging to their mother they may eat Te’rumah, however if he wants to marry off his daughter to a Kohen he must prove that the children were born from this wife according to Reish Lakish.
 
R. Yochanan holds that he may rely on the Chazakah that his children are clinging to his wife even to marry his daughter to a Kohen
 
If a woman was Muchzak by her neighbors that she is a Nidah if her husband has relations with her he is punished with Malkus. (2)
 
If a man and a woman were living as a family together with children, they are Muchzak to be the parents of the children and are Chayav Misah if one of them has relations with one of the children.
 
Re'ish Lakish holds that we rely on a Chazakah to burn Terumah, while R. Yochanan disagrees. (2)
 
If a child is found next to dough of Terumah with some of the dough in his hand, R. Me'ir holds the dough is Tahor, while the Chachamim disagree. (3)
 
Rei’ish Lakish holds that the dough of Terumah is burned, while R. Yochanan holds that it is not burned but it may not be eaten.
 
If dough of Terumah was found with some pieces in it and we don’t know if it was from Sheratzim and it is Tamei, or if it was from frogs and it is Tahor, if Sheratzim are the majority it is Tamei and the Te’rumah is burned even according to R. Yochanan.
 
If a piece of dough of Terumah is inside a house and there are roosters and Tamei liquid next to it, if pockmarks are found in the dough the Te’rumah may not be eaten but it is not burned. (4)
 
The dough is only Tamei if the Tam liquid next to it is clear, but if the liquid is cloudy the dough is Tahor because if the rooster drank from the liquid it would be visible on the dough.
 
A man may not seclude himself with two women but one woman may seclude herself with two men. (5)
 
R. Shimon says that a man seclude himself with two women if his wife is one of them.
 
A person may seclude himself with his daughter or mother.
 
If a child less than thirty days old passes away, when he is taken to be buried it is not necessary to take him in a coffin and he may not be taken out with one man and two women because it is Yichud.
 
Abba Shaul says that even a man with two women may take him out for burial. (6)
 
When a husband is Mekaneh his wife and he brings her to Yerushalayim to drink from the Mei Sotah the Bais Din instruct two Talmidei Chachamim two accompany them to ensure that he will not have relations with her along the way. (7)

A BIT MORE

1. If he neighbors saw that she was wearing the clothes that she usually wears which she is a Nidah she is considered a definite Nidah and if witnesses testify that her husband had relations with her he is Chayav Malkus.
 
2. According to Reish Lakish if someone is Muchzak to be Tamei and he comes into contact with Te’rumah the Te’rumah is burned, while R. Yochanan holds that the Te’rumah is not burned, but it may not be eaten.
 
3. According to R. Me'ir even though most children play in the garbage and are Tamei from the Sheratzim in the garbage since a minority of children are Tahor and the dough is b'Chezkas Tahor we put together the Mi’ut of the children who are Tahor and the Chazakah that the dough is Tahor, while the Chachamim hold that a Mi’ut is meaningless and since the majority of children are Tamei the Rov supersedes the Chazakah that the dough is Tahor.
 
4. Because of the concern that maybe the roosters drank from the Tamei liquid and while their mouth was still wet from the liquid they pecked at the dough.
 
5. However if the men are Perutzim (immoral) one woman may not seclude herself even with ten women
 
6. Abba Shaul holds that at a time of calamity there is no concern of Yichud while the Rabbanan hold that even at a time of calamity there is a possibility that a person will sin.
 
7. A husband may not have relations with his wife who is a Sotah and if he transgresses and has relations with her the Mei Sotah will not have any effect and she is forbidden to him forever.

BRIEF INSIGHT

CHAZAKAH FOR MALKUS
 
The Gemarah states that a person is punished with Malkus as a result of a Chazakah and a person is put to death as a result of a Chazakah, but Terumah is not burned as a result of a Chazakah. However not every Chazakah is the same and a person is only put to death for a very strong Chazakah and Terumah is also burned if it is a strong Chazakah. That which the Gemarah sates that a Terumah is not burned for a Chazakah means that it is sometimes not burned for a Chazakah if it is not a strong Chazakah. Therefore even though Re'ish Lakish holds that we don’t rely on a Chazakah to marry off a daughter to a Kohen he does rely on a Chazakah to burn Terumah because Re'ish Lakish holds that the Chazakah of a child who clings to his mother is not a strong Chazakah while Terumah is brined only for a strong Chazakah. ONE WOMAN MAY NOT SECLUDE HERSELF EVEN WITH A LOT OF MEN UNLESS THE WIFE OF ONE OF THE MEN IS PRESENT AND ONE MAN MAY NOT SECLUDE HERSELF WITH A LOT OF WOMEN. SOME SAY THAT THAT ONE WOMAN MAY SECLUDE HERSELF WITH TWO KOSHER MEN IF THEY ARE IN THE CITY. STAM MEN ARE CONSIDERED KOSHER, BUT IF THEY ARE PERUTZIM EVEN WITH TEN MEN YICHUD IS FORBIDDEN.
