SUMMARY

If three graves are found within four to eight Amos of each other it is a Shechunas Kevaros and the Mesim may not be removed.

If three graves are found within four to eight Amos of each other the ground must be checked within 20 Amos on all sides.

If a grave is found within 20 Amos we must continue to check for another 20 Amos.

If the grave was known, or if the Mes was a murder victim, or he was buried sitting or with his head between his thighs, the Din of Tefusah and Shechunas Kevaros do not apply. (1)

If the Mes that is found is not completely intact, or if the head of one the Mesim is buried next to feet of the other, the Din of Tefusah and Shechunas Kevaros do not apply. (2)

If Mesim are found and one of them is known and two are not or two of them are known and two are not the Din of Shechunas Kevaros does not apply.

When a Mes is moved, the dirt within a depth of three finger widths must be moved with him.

Rava says that if one or two Mesim are found and moved and subsequently a third Mes is found, all of the Mesim should be kept where they are. (3)

If three Mesim are found and after checking within 20 Amos in one direction no additional Mesim are found it is not necessary to check the other directions.

A Safek Nega'im is Tahor if he is not yet Tamei, but once he is Tamei a Safek Nega'im is Tamei. (4)

If the Baheres preceded the white hairs it is Tamei, but if the white hairs were first he is Tahor.

The Tana Kama says that if it is a Safek whether the Baheres preceded the white hairs it is Tamei, but Rebbi Yehoshua says that it is Tahor.

A Zav is checked for seven things after his second emission. (5)

Once a Zav already had two emissions he is no longer checked for these seven things. (6)

Rebbi Eliezer says that he is checked for seven things for the third emission but not for the fourth.

If a victim of violence was originally given a prognosis that he will die and his condition improved and subsequently his condition deteriorated and he died, the perpetrator is Chayav Misah. (7)

A BIT MORE

1. If the Mes was buried sitting or with his head between his thighs he is likely a non-Jew.

2. If the Mesim were buried with the head of one next to feet of the other they are likely non-Jews.

3. According to the second version of Rava the third Mes may be moved as well.

4. If he is not yet Tamei he has a Chezkas Taharah so therefore a Safek is Tahor but once he is Tamei he has a Chezkas Tum'ah so therefore a Safek is Tamei.

5. He is checked whether he ate or drank too much, or carried something heavy, or if he jumped, or was ill, or if he saw something inappropriate or harbored inappropriate thoughts. If any of these things apply the emission will not make him into a Zav.

6. Since he is already a Zav from his first two emissions there is no reason to believe that the third emission was due to an outside factor.

7. Rebbi Nechemyah says that he is Patur from Misah.

BRIEF INSIGHT

SHECHUNAS KEVAROS

If three graves are found within four to eight Amos of each other it is a Shechunas Kevaros and the Mesim may not be removed. The Rosh says that even if only one grave is found it may not be removed if we know for a fact that the Mes was buried there with the intention that he be left there permanently. That which we are allowed to remove a Mes if one or two Mesim are found is because we assume that the Mes was buried there with the intention to eventually move him but if we know for a fact that it is not the case the Mes may not be moved.

QUICK HALACHAH

AN INTENTIONAL MURDER

If someone strikes his friend with a stone or with his fist and, the victim is assessed, if the assessment is that he will live the perpetrator must pay five payments and he is Patur. Even if the condition of the victim deteriorates and he dies the perpetrator is Patur. If they assess that the victim will die and his condition improves and subsequently his condition deteriorates and he dies, the perpetrator is Chayav Misah. We do not make another assessment after his condition improves because there are Raglayim l'Davar. (Rambam Hilchos Rotze'ach 4:3,5)
