CHULIN 31-43 - Two weeks of study material have been dedicated by Mrs. Estanne Abraham Fawer to honor the Yahrzeit of her father, Rav Mordechai ben Eliezer Zvi (Rabbi Morton Weiner) Z'L, who passed away on 18 Teves 5760. May the merit of supporting and advancing Dafyomi study -- which was so important to him -- during the weeks of his Yahrzeit serve as an Iluy for his Neshamah. |

SUMMARY
1. According to Rav, if a dangerously-ill animal cries out in a strong voice, excretes, or moves its ear while it is being slaughtered, the Shechitah is valid. 2. According to Shmuel, it suffices for the animal to act in a way that is not a direct result of death, such as to bend a leg that had been straight. 3. Rav Chisda maintains that when one slaughters an animal that is dangerously-ill, and the animal bends its leg in the middle of the Shechitah, the Shechitah is valid. If the animal bends its leg at the beginning of the Shechitah, the Shechitah is not valid. 4. According to Rav Nachman bar Yitzchak, it suffices for the animal to bend its leg at the beginning of the Shechitah. According to Rava, the Shechitah is valid only if it bends its leg at the beginning. 5. If one slaughtered a dangerously-ill animal at night, and the next morning he found the walls of the Beis ha'Shechitah to be full of blood, the Shechitah is valid, according to Rebbi Elazar. 6. According to the Rabanan, when one slaughters a dangerously-ill animal, and the animal moves a foreleg or hind leg at the time of the Shechitah, the Shechitah is valid. 7. An animal which is a hybrid, or which was born by a Caesarean section, is Pasul for a Korban. 8. If an animal died while giving birth, its offspring that is born is Pasul for a Korban. 9. If one slaughtered a small, dangerously-ill animal, and at the time of the Shechitah it extended its foreleg but did not bring it back towards its body, the Shechitah is not valid. 10. If one slaughters an animal which belongs to a person who worships Avodah Zarah, according to the Tana Kama the Shechitah is valid. 11. According to Rebbi Eliezer, even if one slaughters an animal with intent that one who worships Avodah Zarah will eat from the liver, the Shechitah is Pasul. 12. Rebbi Elazar b'Rebbi Yosi maintains that if the owner of a Korban has a Machshavah of Pigul, the Korban becomes Pigul even though the Kohen did not have a Machshavah of Pigul. Rebbi Yosi disagrees.

A BIT MORE
1. These actions are signs that prove that the animal did not die prior to the Shechitah. 2. If the leg of a small animal was bent and it straightened it upon Shechitah, the straightening of the leg is assumed to be a result of its death and it is not a proof that the animal did not die prior to the Shechitah. 3. If it moves its leg at the beginning of Shechitah and not in the middle or the end, it is possible that it died prior to the end of Shechitah, according to Rav Chisda. 4. According to Rav Nachman bar Yitzchak, even if did not move its leg in the middle or the end, the Shechitah is valid. According to Rava, only when it moves its leg at the end of the Shechitah does this prove that the animal did not die prior to the Shechitah. 5. According to Rebbi Elazar, if blood shot out of its neck with force, the Shechitah is valid. If the Beis ha'Shechitah was covered with blood, one may be certain that the blood shot out of its neck with force. 6. However, according to Raban Shimon ben Gamliel, it must move both a hind leg and a foreleg in order for one to be sure that it was alive until the end of the Shechitah. 7. Even if it is not a hybrid but it does not resemble its mother (for example, it was born from a goat but it looks like a lamb), it is Pasul for a Korban. 8. Even if the mother was alive at the time of the birth and died immediately afterward, it is Pasul for a Korban, because the animal must be alive until after the birth. 9. If it stuck out its hind leg, the Shechitah is valid, even if it did not bring it back towards its body. In contrast, the Shechitah of a large animal is valid even if it stuck out its foreleg and did not bring it back towards its body. If a bird waved its wing at the time of Shechitah, the Shechitah is valid. 10. According to the first Lashon, the Shechitah is valid according to the Tana Kama, because we do not assume that the owner of the Korban had in mind that the Shechitah of the Korban should be for an Avodah Zarah. According to the second Lashon, even if we heard that the owner had in mind that the Shechitah of the Korban should be for an Avodah Zarah, the Shechitah is valid, because the Machshavah of the owner can cause only Kodshim to become Pasul, but not Chulin. 11. The Stam Machshavah of one who worships Avodah Zarah is for Avodah Zarah. Therefore, we assume that the owner had in mind that the Shechitah is for Avodah Zarah. Rebbi Eliezer maintains that the Machshavah of the owner even causes Chulin to become Pasul. 12. According to Rebbi Yosi, only the Machshavas Pigul of the Kohen can cause the Korban to become Pasul, not the Machshavas Pigul of the owner.
