CHULIN 31-43 - Two weeks of study material have been dedicated by Mrs. Estanne Abraham Fawer to honor the Yahrzeit of her father, Rav Mordechai ben Eliezer Zvi (Rabbi Morton Weiner) Z'L, who passed away on 18 Teves 5760. May the merit of supporting and advancing Dafyomi study -- which was so important to him -- during the weeks of his Yahrzeit serve as an Iluy for his Neshamah. |

SUMMARY
1. If an unborn baby animal extended its foreleg out of its mother's womb between the cutting of the first and second Simanim of the mother, there is a doubt about whether it is a Neveilah. 2. Rav Acha bar Yakov maintains that according to Reish Lakish, a Nochri may not eat the lung of an animal that has been slaughtered. 3. Rav Idi bar Avin maintains that one who wishes to eat healthy meat should cut off a piece of meat from the neck of the animal right after Shechitah, while the animal is still alive. The meat may be eaten after the animal dies even by a Nochri. 4. If the Shechitah does not cause any blood to be spilled, the animal is Kosher and may be eaten with Tamei hands. Rebbi Shimon disagrees. 5. A Sheni l'Tum'ah does not make Chulin into a Shelishi l'Tum'ah. 6. The blood of Kodshim is not Machshir food to make it susceptible to Tum'ah. 7. According to Rebbi Meir, a Sheni l'Tum'ah does not make Ma'aser Sheni into a Shelishi l'Tum'ah. The Chachamim disagree. 8. If one puts his hands into a house afflicted with Tzara'as, his hands become a Rishon l'Tum'ah, according to Rebbi Akiva. According to the Chachamim, his hands are a Sheni. 9. The Tana Kama of the Beraisa agrees with Rebbi Akiva that his hands are a Rishon, but only for Terumah and Kodshim, and not for Chulin. Rebbi Shimon ben Elazar disagrees. 10. If one eats an amount of Tamei food of the size of two eggs or more, he becomes Tamei with the same Tum'ah status as the food, according to Rebbi Eliezer. 11. According to Rebbi Yehoshua, if one eats a food which is Tamei with Rishon or Sheni l'Tum'ah, he becomes a Sheni, and if he eats a Shelishi he becomes a Sheni for Kodesh but not for Terumah.

A BIT MORE
1. The Shechitah of the mother permits the unborn baby to be eaten. If the foreleg protruded from the womb during the Shechitah, the Shechitah does not permit it to be eaten. If the foreleg was not in the womb during the entire Shechitah (of both Simanim), then it has the status of a Neveilah, according to the Chachamim. If the foreleg was in the womb when both Simanim were cut, but it extended out of the womb between the cutting of the two Simanim, it might have the status of a Neveilah. The cutting of the first Siman was done in order to permit the foreleg to be eaten, while the cutting of the second Siman was done only to be Metaher it from Tum'as Neveilah; perhaps they do not combine to be Metaher the foreleg from Tum'as Neveilah. 2. Reish Lakish maintains that when the trachea is cut during Shechitah, the trachea and the lung connected to it are considered to have been removed from the body. Nevertheless, since the animal has been slaughtered, for a Jew it is not considered an Ever Min ha'Chai . However, for a Nochri it is considered an Ever Min ha'Chai, since Shechitah for a Nochri has no significance. Since the animal was still alive at the time the lung was considered to have been removed from the body, it has the status of Ever Min ha'Chai. 3. Since the animal has already been slaughtered, it is not considered to be Ever Min ha'Chai, even for a Nochri, according to Rav Idi bar Avin. Rav Idi bar Avin disagrees with the logic of Rav Acha bar Yakov that it is considered to be Ever Min ha'Chai for a Nochri, and he maintains that since it is permitted for a Yisrael, it is permitted for a Nochri as well. However, even a Yisrael may not eat it until the animal dies, since it is forbidden to eat meat from an animal while it is still alive, even if it is not an Ever Min ha'Chai. 4. According to the Tana Kama, since no blood was spilled the flesh does not become susceptible to Tum'ah. According to Rebbi Shimon, even a dry Shechitah causes the flesh to become susceptible to Tum'ah. 5. However, a Sheni l'Tum'ah does make Terumah into a Shelishi, and a Shelishi makes Kodesh into a Revi'i. 6. However, the flesh of Kodshim is susceptible to Tum'ah even without coming into contact with liquid, because Chibas ha'Kodesh is tantamount to Hechsher. 7. However, Rav Simi bar Ashi maintains that even the Rabanan admit that only if a Sheni eats Ma'aser Sheni does it become a Shelishi, but not if he merely touches Ma'aser Sheni. 8. Rebbi Akiva and the Chachamim agree that Min ha'Torah his hands are not Tamei at all, because a partial entry into the house is not regarded as an entry into the house (because if it would be regarded as an entry, his entire body would be Tamei). However, mid'Rabanan his hands are Tamei. 9. According to Rebbi Shimon ben Elazar, if one puts his hands into a house with Tzara'as, his hands become a Rishon even for Chulin. 10. If he ate food that is a Rishon, he becomes a Rishon. If he ate food that is a Sheni, he becomes a Sheni. If he eats food that is a Shelishi, he becomes a Shelishi. 11. When Rebbi Yehoshua says that he becomes a Sheni for Chulin, he refers to Chulin which is being treated with the level of Taharah of Terumah, because otherwise Chulin cannot become a Shelishi. However, if the Chulin is being treated with the Taharah of Kodesh, it does not become a Shelishi.
