SHEVUOS 23 (3 Teves) - Today's Dafyomi material has been dedicated in memory of Hagaon Rav Yisroel Zev Gustman Ztz"L (author of "Kuntresei Shiurim") and his wife, Rebbetzin Sarah Gustman (daughter of Hagaon Rav Meir Bassin, a Dayan in Vilna) in honor of the Yahrzeit of the Rebbetzin. Sponsored by a number of Rav Gustman's Talmidim (Rabbis Avrohom Feldman and Mordecai Kornfeld).

SUMMARY

1. Wine may be purchased in Yerushalayim with money of Ma'aser Sheni.
 
2. A Kohen who is inebriated from dates of Ke'ilit, from milk or from honey, who performs the Avodah in the Beis ha'Mikdash is Chayav Misah.
 
3. A person who swears that he will not eat is Chayav only once if he eats and drinks.
 
4. A person who swears that he will not eat and he will not drink is Chayav twice if he eats and drinks.
 
5. A person who swears that he will not eat is exempt from a Korban if he eats food or drink which is not fit for eating or drinking.
 
6. A person who swears that he will not eat is Chayav only once if he eats wheat bread, barley bread, rye bread and oat bread.
 
7. A person who swears that he will not drink is Chayav only once if drinks many types of liquid.
 
8. If a person claims that his friend owes him wheat, barley and rye and the friend swears falsely that he does not owe him anything, he is Chayav only one Korban.
 
9. Rebbi Yochanan maintains that if he swears on the sum of one Perutah from a combination of wheat, barley and rye he is Chayav a Korban.
 
10. A person who swears that he will not eat is Chayav a Korban according to the Tana Kama if he eats Neveilos or Tereifos. Rebbi Shimon says he is exempt from a Korban.

A BIT MORE

1. The Torah states that the money of Ma'aser Sheni shall be used for something which will be eaten in Yerushalayim. Nevertheless wine may be purchased with the money because drinking is also regarded as eating.
 
2. Dates from a place called Ke'ilit can cause a person to become inebriated. This is also true regarding someone who drinks a lot of milk or eats a lot of wine.
 
3. Although drinking is included in the Shevu'ah and he both ate and drank nevertheless he is only Chayav once, just as someone who eats twice in one He'elem (without knowing in between that he sinned) is only Chayav once.
 
4. Although drinking is normally included when he swears that he will not eat; since it is included in the first Shevu'ah the second Shevu'ah that he will not drink should not go into effect. However, in this case it is regarded as two separate Shevuos because when he subsequently swore that he will not drink he was making it clear that drinking was not included in the first Shevu'ah that he will not eat.
 
5. However, if he specified in his Shevu'ah that he will not eat an item that is not fit for eating he is Chayav if he eats it.
 
6. However, if he swears that he will not eat wheat bread, barley bread, rye bread and oat bread he is Chayav separately for each one.
 
7. However, if he has wine, oil and honey in front of him and he swears that he will not drink wine, oil and honey he is Chayav separately for each one. Rav Achah the son of Rav Ika says if his friend urges him to eat wine, oil and honey with him and he swears that he will not drink wine, oil and honey he is Chayav separately for each one.
 
8. If he wears falsely that he does not owe him wheat, barley and rye he is Chayav for each one.
 
9. If he swore that he does not owe anything without specifying wheat, oats, or rye he is Chayav for one Perutah from a combination of all three. However, if he specifies wheat, barley and rye in his Shevu'ah Rav Acha and Ravuna disagree whether he is Chayav a Korban for a Perutah from a combination of all of three. According to one of them when he specifies all three he is Chayav four Korbanos. Besides swearing separately on each one he is also swearing a general Shevu'ah on all three together. On the general Shevu'ah of all three together he is Chayav for one Perutah from a combination of the three.
 
10. Rebbi Yochanan, Rav and Shmuel maintain a Shevu'ah which affirms a Mitzvah does not go into effect. However if someone vows not to eat prohibited items along with permitted items it is an effective Shevu'ah according to the Tana Kama. Reish Lakish maintains if someone vows not to eat prohibited items the Shevu'ah goes into effect if he included less than the size of an olive in his vow according to the Tana Kama.
