SUMMARY

1. Tana Kama: A goat gave birth to three goats, and each of those three goats gave birth to three more goats. They all went into the pen to have Ma'aser Behemah taken from them. Rebbi Shimon says, "I saw a goat that had ten offspring within a year."

2. An animal that is not old enough to be brought as a Korban still enters the pen and is counted for Ma'aser Behemah.

3. Rav and Shmuel disagree about what type of blood indicates that an animal that gave birth.

4. There is a disagreement in a case of a Jew who sold an animal to another Jew but did not mention whether it had given birth.

5. Rebbi Eliezer ben Yakov: A bloody entity passed by an animal should be buried, and it causes the animal's future offspring to be exempt from the laws of a firstborn.

A BIT MORE

1. The Gemara suggests various ways of understanding the disagreement between the Tana Kama and Rebbi Shimon. (Many of them are similar to the way the Gemara attempts to explain the disagreement between Rebbi Yishmael and Rebbi Akiva on Daf 20, #1-3.)

2. Rebbi Shimon derives this from the law of the firstborn animal. Just as a firstborn animal is holy from birth but can be brought as a Korban only when it is older, a young animal may be counted for Ma'aser Behemah (and if it is the Ma'aser Behemah animal, it may be offered when it is old enough to be a Korban).

3. One must show the animal to a shepherd who is expert in this type of blood in order to ascertain that it had given birth previously (and, consequently, that its offspring is exempt from the laws of a firstborn animal).

4. Rav says that any offspring is certainly a firstborn; had it given birth previously the seller would have praised it to the buyer by saying that it gives birth. Shmuel says that the offspring is a doubtful firstborn, since the seller may not have mentioned it because he thought the buyer wanted it for its meat. Rebbi Yochanan says that the offspring is not a firstborn; had it not given birth the seller would have made sure to mention that the firstborn should be treated as a firstborn.

5. It should be buried, because it might have been a male firstborn which had the holiness of a firstborn at birth.
