May the merit of supporting and advancing Dafyomi study -- which was so important to him -- during the weeks of his Yahrzeit serve as an Iluy for his Neshamah. |

SUMMARY
1. The Mishnah states that all Kohanim, Leviyim, Yisraelim, women, and servants may pledge to donate the set value or actual value of another person. Others may pledge their set or actual value as well. 2. The Gemara infers other cases that are included in the law of the Mishnah. 3. The Gemara discusses other Mishnayos that open with the word "ha'Kol," "everyone" or "everything," and what it includes. 4. The Gemara discusses other Mishnayos that start with the word "ha'Kol," "everyone" or "everything," and which include the fact that a minor at a certain age must also start to perform these commandments. 5. Beis Hillel: A person who is half-Eved Kena'ani and half-free works for his master every other day; the alternate day he works for himself. Beis Shamai: His master is forced to free him. The servant writes a document stating that he owes half of his value to his former master.

A BIT MORE
1. The exception to the Mishnah's law is a Tumtum and Androginus, who have no set value. Also excluded are a Cheresh, Shoteh, and a Katan, who cannot pledge to give any value to Hekdesh. According to Torah law, they are not considered to have the mental faculty to make a pledge. 2. The pledge of a twelve year old boy is included. A person whose body is full of boils still has a set value based on his age, despite the fact that his actual value is nothing. 3. For example, when the Mishnah says "ha'Kol" with regard to Semichah, it teaches that an heir performs Semichah on an inherited sacrifice. In the case of Temurah, the word "ha'Kol" includes the fact that an heir can effectively make a Temurah with an inherited sacrifice. 4. For example, when the Mishnah says "ha'Kol" with regard to Sukah, it teaches that a minor who does not generally need his mother is obligated in the Mitzvah of Sukah. When the Mishnah says "ha'Kol" with regard to Lulav, it means that a minor who knows how to shake a Lulav is obligated in the Mitzvah of Lulav. 5. Beis Hillel later retracted his opinion, due to Beis Shamai's convincing argument that the half-Eved, in that state, is unable to fulfill the commandment to marry and bear children.
