WHEN A KOHEN CAN MARRY A CONVERT (Yerushalmi Halachah 6 Daf 45b)

דלמא רבי הושעיה רבא ורבי יודה נשייא הוון יתבין רהיט רבי יוחנן ולחיש לרבי הושעיה באודניה פצוע דכא כהן מהו שישא בת גרים.

(a)

Once, R. Hoshiyah Rabah and R. Yehuda HaNasi were sitting and R. Yochanan ran in and whispered into R. Hoshiyah's ear, "Can a Kohen with squashed testicles marry the daughter of converts (and feed her Terumah)?

אמר ליה מה אמר לך

R. Yehudah HaNasi to R. Hoshiyah: What did R. Yochanan say to you?

אמר ליה אמר לי מילה דנגר בר נגרין לא מפריק לה.

R. Hoshiyah replied: He asked me something that both a Talmid Chacham and his son cannot answer...

לא אמר לי [דף מו עמוד א] גיורת שהיא כזונה אצלו ולא בת ישראל שהיא מחללה [דף נ עמוד ב (עוז והדר)] לא אמר לי אלא בת גרים

He did not ask me about a convert, as she is like a 'zonah' (who is certainly prohibited to Kohen); nor did he ask me about a bas Yisrael, as he certainly made her a chalalah when he had relations with her; he asked me about the daughter of converts.

ובת גרים לא כישראלית היא

R. Yehudah HaNasi: But isn't she the same as a bas Yisrael, (that relations with her would make her a chalalah)?!

פתר לה כרבי יודה דרבי יודה אמר בת גר זכר כבת חלל זכר.

Answer: It is according to R. Yehudah, that the daughter of a convert is like the daughter of a chalal. (Do we say that even though she may not marry a Kohen, she is not actually a 'zonah', nor does she become a chalalah through relations with him since she is already prohibited to him; or alternatively, since she is prohibited to a Kohen, even a Kohen with such a blemish will be included in that prohibition?)

כהן שבא על הגרושה והוליד בת בת בת מה היא

(b)

Question: If a Kohen married a divorcee and they had a daughter, what is the status of her daughter?

ר' חנניה ורבי מנא חד אמר כשירה. וחד אמר פסולה.

(c)

Answer: R. Chananyah and R. Mana disagreed - one said she is Kasher and one said she is Pasul.

מתיב מאן דאמר כשירה למאן דאמר פסולה בת חלל זכר (אינה) פסולה

(d)

Question (the one who said Kasher to the one who said Pasul): Our Mishnah taught - A chalal's daughter is pasul. (This implies that the daughter of his daughter is Kasher?!)

וחללה מבנה אינה פסולה. משם מה היא פסולה.

Answer: The correct implication of the Mishnah is that after the mother became a chalalah (from relations with a Kohen), if she had a daughter with a Yisrael, that daughter may marry a Kohen. (Since her mother had originally had a status of Kasher, why would the daughter be Pasul when she was born from a permitted relationship? On the other hand, the daughter of a chalal never had a status of Kasher, so her daughter is also Pasul.)

רבי אליעזר בן יעקב אומר כו'.

The Mishnah taught the statement of R. Eliezer ben Yaakov (see earlier 77-1) (d)), that only the daughter of two converts may not marry a Kohen.

תמן תנינן רבי אליעזר בן יעקב אומר האשה בת גרים לא תינשא לכהונה עד שתהא אמה מישראל.

Mishnah in Maseches Bechoros: R. Eliezer ben Yaakov says that a daughter of converts may not marry a Kohen unless her mother was born a Yisraelis.

וכולהו מקרא אחד דרשו (יחזקאל מד) כי אם בתולות מזרע בית ישראל.

All of the tanaim in the Mishnah learn their views from the same pasuk that states in reference to the permitted marriages of a Kohen Gadol (Yechezkel 44, 22), "...only virgins from the offspring of the House of Yisrael''...

רבי יודה אומר עד שיהא אביה מישראל.

R. Yehudah: Her father must be a Yisrael (as learned from the phrase 'from the offspring - i.e. the father is from the House of Yisrael').

רבי ליעזר בן יעקב אומר עד שיהא או אביה או אמה מישראל.

R. Eliezer ben Yaakov: Her father or mother must be a Yisrael (as offspring can refer to either parent).

רבי יוסי אומר עד שיוולדו בקדושת ישראל.

R. Yosi: She must be born a Yisraelis ('from the offspring' means she was conceived and born a Yisraelis).

רבי שמעון אומר עד שיבואו בתולים בקדושת ישראל.

4.

R. Shimon: Her besulim (hymen) must have grown when she was already a Yisraelis (i.e. that her besulim grew and were completed when she was already a Yisraelis, which happens at aged 3).

תני בשם ר' שמעון גיורת שנתגיירה פחותה מבת שלש שנים ויום אחד כשירה לכהונה.

(h)

Beraisa (in the name of R. Shimon): If a girl converted under the age of 3, she may marry a Kohen.

מה טעמא (במדבר לא) וכל הטף בנשים אשר לא ידעו משכב זכר החיו לכם. ופינחס עמהן.

(i)

What is his source? The pasuk states (Bamidbar 31, 18), "But all of the young children among the women who have not known lying with a male, you may keep alive for yourselves''. (The pasuk is permitting all of the soldiers to marry these girls) and Pinchas (who was a Kohen) was amongst them.

מה עבדין ליה רבנין החיו לכם לעבדים ולשפחות.

How do the Rabbanan understand that pasuk? Keep them alive to be slaves and slave women.

R. Yosa/ R. Yasa citing R. Yochanan/ R. Yona/ R. Chiya citing R. Yochanan: The Halachah follows R. Yosa.

חנין בר בא בשם רב הלכה כרבי יוסי. והכהנים נהגו כרבי אליעזר בן יעקב.

Chanin bar Ba citing Rav: The Halachah follows R. Yosi but the Kohanim accustomed themselves to follow R. Eliezer ben Yaakov.

חד כהן נסב בת גרים. אתא עובדא קומי רבי אבהו וארבעיה אספסליה.

(m)

Once, a Kohen married the daughter of converts. The case came before R. Abahu and he laid him on a bench (to whip him).

אמר ליה רב ביבי לא כן אלפן רבי הלכה כרבי יוסי.

R. Baybei to R. Abahu: Did you not teach us that the Halachah follows R. Yosi?

אמר ליה ולא נהגו הכהנים כר''א בן יעקב.

R. Abahu: Did the Kohanim not accustom themselves to follow R. Eliezer ben Yaakov?

א''ל ר' על המנהג לוקין.

R. Baybei: Do you give lashes for (transgressing) a custom?

א''ל אין כיני את חמי מפייס ואנא מוקים ליה.

R. Abahu: Yes. I realize that you are trying to dissuade me from giving him lashes. I will lift him up (without giving lashes).

מן דקיימי אמר ליה ר' הואיל והותרה הרצועה אף אני מותר בה.

After they got up, the Kohen said to R. Abahu, "Rebbe, since you have released the strap (used for lashes), I am also permitted to marry her.

ר' יעקב בר אידי בשם רבי יהושע בן לוי מעשה (בשפחה) [במשפחה] בדרום שהיו קורין עליה ערר ושלח רבי את רומינוס לבודקה ובדק ומצא שנתגיירה זקינתה פחותה מבת שלש שנים ויום אחד והכשירה לכהונה.

R. Yaakov bar Idi citing R. Yehoshua ben Levi: There was once a family in the south that was rumored to be pasul to Kehunah. Rebbi sent R. Ruminus to investigate and he discovered that their grandmother had converted under the age of 3; therefore, Rebbi permitted their daughters to marry Kohanim.

רב הושעיה אמר כרבי שמעון הכשירוה

Rav Hoshiyah: They permitted them according to R. Shimon (see above, (g) 4.).

[דף נא עמוד א (עוז והדר)] אמר רבי זעירה דברי הכל היא (הכא) [הדא] דאמר רבי זעירא בשם רב אדא בר אחוה רבי יודן מטי בה בשם רב רבי אבהו בשם רבי יוחנן וולד בוגרת כשר שהוא בלא תעשה שהוא מכח עשה (ויקרא כא) והוא אשה בבתוליה יקח לא בוגרת כל לא תעשה שהוא בא מכח עשה עשה הוא.

R. Zeirah: The granddaughters were permitted according to all opinions, as R. Zeirah said, citing R. Ada bar Acha/ R. Yudan citing Rav/ R. Abahu citing R. Yochanan - if a Kohen Gadol had relations with a Bogeres (a girl over the age of 121/2 - her besulim dry up after she reaches that age, so she can no longer marry a Kohen Gadol) - the child is Kasher. This is because this prohibition is only learned through a deduction from the positive Mitzvah for him to marry a virgin (i.e. a girl with besulim), as the pasuk states (Vayikra 21, 13), "He shall take a woman with besulim (a virgin)'' - and the rule is that any prohibition learned from a positive Mitzvah is considered a positive Mitzvah (that cannot disqualify the children from the Kehunah).

ודכוותה כי אם בתולה מעמיו יקח אשה לא גיורת כל לא תעשה שהוא בא מכח עשה עשה הוא.

Another example is (Vayikra 21, 14), "only a virgin among his nation he shall take as a wife'' - but not a convert. Since it is a prohibition learned from a positive Mitzvah, it is considered to be a positive Mitzvah.

התיב רבי הושעיה הרי דור שני של מצרי הרי הוא בלא תעשה שהוא בא מכח עשה עשה הוא.

(q)

Question (R. Hoshiyah): It is a negative prohibition to marry a second generation Mitzri (meaning that if a Kohen would marry her, the child is a Chalal), even though it is learned from the pasuk that allows one to marry (only) a third generation Mitzri?

חזר רבי הושעיה ואמר לא דומה עשה שבישראל לעשה שבכהנים. עשה שבישראל אסור בכל. עשה שבכהנים אסור בכהנים ומותר בלויים ובישראל:

Retraction (R. Hoshiyah): A positive Mitzvah of a Yisrael is not the same as a positive Mitzvah of Kohanim - the positive of a Yisrael applies to all (so it is considered a full negative Mitzvah to marry the second generation Mitzris); a positive Mitzvah of Kohanim only applies to Kohanim but not Yisraelim (and is not so stringent).

BELIEVING A PARENT ABOUT A CHILD'S STATUS (Yerushalmi Halachah 7 Daf 46b)

[דף מו עמוד ב] משנה האומר בני זה ממזר אינו נאמן ואפי' שניהן אומרין על העובר שבמעיה ממזר הוא אינן נאמנין רבי יהודה אומר נאמנין:

(a)

(Mishnah): If a man says, "My son here is a Mamzer'', he is not believed. Even if both parents say about a fetus in her womb that it is a Mamzer, they are not believed. R. Yehudah says that they are believed.

גמרא תמן תנינן האומר בני זה נאמן.

(b)

(Gemara - question): But the Mishnah in Maseches Bava Basra teaches that if he testifies about a certain son, he is believed...?

רבי אבהו בשם רבי יוחנן לתת לו אבל לא ליקח ממנו.

(c)

Answer (R. Abahu citing R. Yochanan): He is believed to give him his inheritance but he is not believed to take away from him (his inheritance by declaring him a Mamzer).

א''ר יוסי ולא מתניתא היא אפי' שניהן אומרין על העובר שבמעיה ממזר הוא אינן נאמנין.

(d)

Question (R. Yosi): Surely this is written explicitly in our Mishnah - even if both parents say about a fetus in her womb that it is a Mamzer, they are not believed?!

דילמא על דרבי יהודה איתאמרת דר' יודה אומר נאמנין עליה ר' אבהו בשם רב יוחנן לתת לו אבל לא ליקח ממנו

(e)

Answer: Perhaps R. Abahu was discussing R.Yehudah, who said that they are believed - i.e. only to give to him but not to take away from him.

אמר ר' חזקיה עוד היא מתניתא (דברים כא) כי את הבכור בן השנואה יכיר.

(f)

Question (R. Chizkiyah): This is also learned from a Beraisa - the pasuk states (Devarim 21, 17), "Rather, he must recognize the firstborn of the hated (wife)''...

היו מחזיקין בו שהוא בנו ובשעת מיתתו אמר אינו בנו אינו נאמן.

If a certain son was known as the firstborn and on his deathbed the father claimed that his son was not his son, he is not believed.

שאינו בנו ובשעת מיתתו אמר בני הוא נאמן.

2.

If a certain man was known not to be his son and on his deathbed the father claimed that he was in fact his son, he is believed.

אית תניי תני על קדמייתא נאמן.

(g)

Another Beraisa teaches that he is also believed in the first case.

ר' חזקיה ר' זריקן בשם רבי הונא היו מחזיקין אותו שהוא משפחתו נאמן.

(h)

R, Chizkiyah and R. Zerikan citing Rav Huna: If he had been known to be part of their family, he is believed.

היה עומד בצד המוכסין ואמר בני הוא וחזר ואמר עבדי הוא נאמן.

If he was standing next to the tax collectors and he said "He is my son'' and he later said, "He is my slave'', he is believed.

עבדי הוא וחזר ואמר בני הוא אינו נאמן.

2.

If he said, "He is my slave'' and later said, "He is my son'', he is not believed.

אית תניי תני נאמן.

Another Beraisa teaches that he is believed.

אמר ר' מנא כגון אילין כותאי דינון משעבדין בבניהן.

i.

R. Mana: For example, these Kutians, whose sons serve them (and they must pay more tax on their sons, so they claim that their sons are their slaves).

[דף נא עמוד ב (עוז והדר)] תני נאמן על (הגדול) [הקטן] ואינו נאמן על (הקטן) [הגדול].

Beraisa: He is believed about a child but not about an adult.

Question: Who is considered an adult?

רבי זעירא אמר כל שיש לו אשה ובנים. רבי אבהו בשם רבי יוחנן כל שיש לו אשה

Answer: R. Zeirah - Only if he already has a wife and children. R. Abahu citing R. Yochanan - if he has a wife.

מתניתא פליגא על רבי אבהו גר שמל ולא טבל והיו לו בנים ואמר מלתי ולא טבלתי נאמן ומטבילין אותו בשבת.

Beraisa against R. Abahu: 'If a convert was circumcised but had not yet immersed and he had children, he is believed to say that he was circumcised but had not immersed (meaning that he did not become Jewish) and we can even immerse him on Shabbos.

Answer: R. Abahu holds that a convert does not require both circumcision and immersion - circumcision is enough - therefore, immersing is permitted on Shabbos since he is already Jewish without it. It is for this reason that he is also believed, since he is already Jewish and he is not disqualifying himself.
