DAF DISCUSSIONS - ROSH HASHANAH 10

Yoni Sudwerts asked:

The Baraisa at the bottom of 9b that continues into 10a. My understanding of it (based on Artscroll) is: If someone plants a tree 30 days or more before Rosha Hashana, then those "few" days are counted as a full year, yet nontheless, he is required to wait until Tu-B'Shvat for the Orlah and Revaii periods to end. Now, Artsrcoll seems to see if he does it "before" 30 days before, then Orlah and REvai simply end on Rosh Hashana itself.

So, my question is: What is the "limit" how long before "30 days before" woudl the tree need to be planted to enable the person to eat the Orlah/Revai fruits at Rosh Hashana as opposed to having to wait until Tu-B'Shvat.

Thank You,

Yoni Sudwerts, Yerushalayim

The Kollel replies:

Dear Yoni,

The following is based on Insights Into The Daily Daf (see there at length):

All opinions hold that if planting is after Tu B'Shvat one must wait until Tu B'Shvat.

However if planting is before Tu B'Shvat, (even if after Rosh Hashanah) then accordig to Rashi until Rosh Hashanah is sufficient.

According to the Ra'avad one must wait until Tu B'Shvat unless the first year is full (from Rosh Hashanah).

The Rambam is a third opinion. When planting is before Rosh Hashanah -a full year- then until Rosh Hashanah is sufficient. After Tu B'Shvat, -wait until Tu B'Shvat, and when planting between Rosh Hashanah and Tu B'Shvat wait after Rosh Hashanah until the same day of planting 3-4 years later.

All the best,
