DAF DISCUSSIONS - BEITZAH 40

Joseph Kayeri asks:

Hi

Id like to know what case exactly is the case of the Mishnah, in light of th first mishnah of Perek En Sadin, here in Masechet Beitsah. Is the mishnan here saying that even animals that are already traped (nisodin veomdin), if they are midbaryot, they are not allowed to be slaughtered on yom tov, and if so, why? or the pshat is that animals that are not traped may not be slaughtered only if they are midbaryot/ but this seems strange..

Joseph Kayeri, Sao Paulo Brazil

The Kollel replies:

There is no problem of trapping in Beitzah 40; the animal "walked in" and is [now] available. But since Midbar animals showed up on Yom Tov, they have a Muktzah problem since they were not available when Yom Tov began, and that prevents slaughtering them and using them. If they are Baisiyos, then they are "in mind" and are not Muktzah.

All the best,

Joseph Kayeri asks:

So the trapping in perek en sadin is merely an Hachana?! There is no connection with the melacha of seidah/trapping?

The Kollel replies:

In Beitzah 23b-24a, we learn that when the animal is free and not caught, then to trap it is the Melachah of trapping. That depends on the type of animal, size of area, etc.

Here, in Beitzah 40a, the animal "trapped" itself. There is nothing more to trap, and the whole discussion is the slaghtering. Does that make sense?
