Hi.

In Succah 4B the Gemerah deals with four poles on each corner of a roof, with appropriate s'chach, and whether we use the concept of gud asik to provide the four walls to make the succah kosher. In Davarin 22-8 we have the obligation of every roof needs a fence to prevent accidental harm.

How does the Gemarah format halacha based on a case where no Makah (roof fence)is present?

The Kollel replies:

There is not always an obligation of Makeh in such a case. For example, there is a discussion among the Poskim if the roof is that of a shul whether or not a Makeh need be placed. Additionally, if the house would be owned by a Nochri (and the Jew would merely have permission to build a Sukah on his property) it would not be obligated in Makeh. There are other possible cases as well (see Minchas Chinuch Mitzvah 546).
