Henoch Singer asks:

Even according to R'Shimon, Todos shouldn't have done what he did, because people may suspect that he was Makdish it before he slaughtered or roasted it?

The Kollel replies:

The Gemara says that it seems "close to" eating Kodshim outside the Beis Hamikdash but it doesn't say that it looks like eating Kodshim outside. The Ksav Sofer (Yoreh Deah 84) proves from this that if a person does not explicitly state "this is for Pesach" there is no real concern that it could be interpreted as a Pesach even if it is made in the way a Pesach is.

However this explanation won't help according to Rambam who explicitly states that the Gedi Mekulas "looks like Kodshim outside" and is therefore forbidden, even though he also Paskens like Rabbi Shimon. We must therefore say that Rabbi Shimon quoted Todos in order to show that despite the fact that this could not technically be a Korban since it was not sanctified the regular way, one should not make this form of Gedi Mekulas on Pesach since it looks like one might have been Makdish beforehand and there is Maris Ayin.
