Hi - I just wanted to make a ha-arah on what the Rov wrote in the Insights to the daf with regard to the machlokes Rashi and Tosfos regarding hefker and its relationship to peiah. The Rov asked according to Rashi what was the problem with what anshei yericho did if they made the yerek hefker. If you look in the Maharsha - he clearly explains that the taitch in Rashi is not that the Aniyim will eat something that they should have taken maaser from but rather that you are "stealing" from the levi by being mafkir part of your field for the aniyim. In fact - since it is hefker the aniyim do not have to take off maasros.

The Kollel replies:

The Maharsha seems to be noting that Rashi in the Mishnah (56a) explains differently than Rashi in the Gemara (57a).

In the Mishnah, Rashi does not mention a word about the Levi, and clearly states that the problem is that they are think they are eating Pe'ah but it is actually Tevel. The Maharsha (57a) says that this is in fact the explanation of Tosfos as well. (As pointed out in the Insights, Tosfos explains why it is not Hefker).

The Maharsha begins by saying that Rashi in the Gemara (57a) seems to explain that the problem is that he is stealing from the Levi by making it exempt from Ma'aser, and that Tosfos did not want to give this explanation.
