DAF DISCUSSIONS - ERCHIN 22

Barry Epstein asked:

If debtor is alive, damages collected from superior land, loan from average land and kesubah from inferior land. If he owes $10,000, it can be paid in a certain amount of acres of superior land or a greater amount of inferior land. Why is the type of land specified? Shouldn't it be the dollar amount of land that matters?

Barry Epstein, Dallas, USA

The Kollel replies:

The dollar amount is constant; one collects as much as he is owed, not a penny more or a penny less. In addition, one must pay damages with prime land which is more desirable.

Barry Epstein asked:

Thank you for your response. I don't understand why an acre of superior land worth $10,000 is worth more than 2 acres of average land worth $5,000. Re damages, why is the former more valuable when the two choices have equal value?

The Kollel replies:

It is not more valuable, and it may not be more valuable, for one must pay what he damaged and no more, no less. Rather, it is more desirable.
