DAF DISCUSSIONS - BAVA METZIA 52

am asked:

how is it that the mishna goes until the shiur, while the beraisa includes it and each shiur is onnah? the mishna says kama and the braisa says ad kama! i know it has to do with the gemara's answer of maalah lmatoh and vice versa, but i'm a little confused.

am, b'klyn, NY

The Kollel replies:

Dear am,

At first, the Gemara understands the Mishnah as saying "what deficiency is not called Ona'ah so that the Shiur such and such is permitted". But the Beraisa lists the same Shiur and asks "until how much... is Ona'ah forbidden". (A large deficiency is forbidden, so how small a deficiency is still forbidden).

There is therefore a contradiction concerning the Shiur itself.

The Gemara answers that the exact Shiur is forbidden. Tosfos explains, based on a later Gemara, that to say the exact Shiur is permitted cannot be correct.

The Mishnah therefore means "until what Shiur, not including the Shiur itself, is permitted" (from a small deficiency until a large deficiency) and the Beraisa means as was explained before. (A large deficiency is forbidden, so how small a deficiency is still forbidden).

All the best,

Reuven Weiner.
