DAF DISCUSSIONS - BAVA METZIA 24

elozer kanner asked:

Dear rabbi kornfeld,

what is the character of eidus with regard to identifing a lost object? siman or tveyis ayin or something else?

elozer kanner

The Kollel replies:

Definitive Eidus, where the witnesses testify that they can conclusively say that this object belongs to Ploni (i.e. they saw it drop out of his hand and that it was picked up by the finder), would certainly entitle the person to his lost object (unless it was picked up after the person had already had Yiush). However, the Shulchan Aruch (CM 267:9) rules that witnesses are even better than Simanim, and in a case where one would bring witnesses who simply know (without anything besides Tviyas Ayin) that the object is his, one would claim the object even against someone who would bring Simanim.

All the best,

Yaakov Montrose
