DAF DISCUSSIONS - BAVA KAMA 72

Hedy Zaghi asks:

Shalom Rabbi,

Again thank you for your response.

I have another question that is about false witnesses.

In the mishna at the bottom of 72b, it is stated that: " if one of the latter (witnesess) was found to be a zomeim, etc."

Since a pair of witnesess have to come TOGETHER, how could it happen or how is it possible to have a situation that only one of is zomeim?!

If they are coming together, and if one is a zomeim, the second one is also conspiring against the person they want to cause damage to. That is if we assume one is a zomeim, then obviously the second one is also aware that the first one is lying.

I hope the question is clear.

Thank you so much,

Shabbat Shalom

Hedy Zaghi

The Kollel replies:

Sholom Rav,

Suppose Reuven and Shimon get together and testify (falsely) in Beis-Din that A murdered B. Then along come two witnesses who testify that Reuven (but not Shimon) was with them when he claimed that he saw the murder. Then Reuven is an Eid Zomeim but not Shimon.

I think you forgot that a witness can be false even without being an Eid Zomeim.

Be'Virchas Kol Tuv,

Eliezer Chrysler
