Before the Gemar Din, the Shor belongs to its owner and it does not yet have a Din of Isurei Hana'ah.
Regarding the payment of a fine, there is no one to pay it to. The Nizak has already been reimbursed. There is no reason to pay to Beis Din, because the owner used it before it became Asur.
