DAF DISCUSSIONS - KIDUSHIN 9

SNMS14@aol.com asked:

Daf nine speaks about things which are koneh biamirah, the tenaim that were agreed upon by the respective fathers. From the gemara, it appears that these tenaim were only binding if there subsequently was kiddushin-How did these tenaim evolve into the modern day tenaim? Is there a relation between the two?

Do modern day tenaim have any legal significance between the chassan and kallah?

The Kollel replies:

Tenaim include any stipulations between the sides. Today, just as then, if the Kidushin is not made immediately, they need a Kinyan. The substance is the same, the only difference is how the Chiyuv takes effect: with a Kinyan or without. The Tenaim bind whoever takes the responsibility, be it the Chasan or someone standing in his stead (such as his father).
