DAF DISCUSSIONS - GITIN 38

m sulzbacher asked:

is there such a concept of mafis temimim when you are makdish your eved ledomim, (the value of my servant on me,-demay avdy oly)?many thanks!

m sulzbacher, london england

The Kollel replies:

(a) Rashi DH Ee Hachi does compare Matfis Temimim to Makdish Eved l'Damim. He writes that the reason the Gemara does not say that the Beraisa refers to where he said that the servant is "Kadosh l'Damav" is because since it is appropriate to use the words of Kedushah concerning an Eved - because this can mean that he should be part of the holy people - if one would say Kadosh l'Damav this would mean that the Kedushah applies on the Eved so that he should become a free man.

Rashi compares this to Matfis Temimim for the Bedek ha'Bayis i.e. to belong to the Beis ha'Mikdash but not to be sacrifices to be offered up on the Mizbe'ach. If one tries to Matfis Temimim they always remain fit for the Mizbe'ach. Similarly Rashi asserts that if one says the "Eved is Kadosh l'Damav" this automatically means he would be a free man.

In other words the common factor of Matfis Temimim and of Makdish Eved l'Damav is that they possess Kedushah - the Temimim always remain fit for the Mizbe'ach, and the Eved becomes a part of the holy people.

(b) Tosfos DH Gufei asks on Rashi that one cannot compare Makdish Eved l'Damim to Matfis Temimim because otherwise one should say that just as with Matfis Temimim - when they are redeemed the proceeds go to the Bedek ha'Bayis - similarly even though the Eved goes free, one should have to redeem him and the proceeds would go to Bedek ha'Bayis.

(c) Pnei Yehoshua answers Tosfos question on Rashi by making a distinction between whether one said explicitly that the "Eved" is Kadosh l'Damav or not. Since Rashi compares Makdish Eved l'Damav to Matfis Temimim, just as Matfis Temimim refers to a case where he said explicitly that he is Makdish for the Bedek ha'Bayis, so Makdish Eved l'Damav must be referring to where he said explicitly to the Eved that he is holy l'Damav. In contrast, when Rav stated that someone sanctifies his Eved - this does not refer to a case where he explicitly said he is Makdish l'Damav but rather he was Makdish without saying anything additional. In such a case, since he does not specify on what conditions he is Makdish, we say this means he goes free, but there is no logic in saying he must give it's value to the Beis ha'Mikdash because he was not Makdish it for the latter.

According to this, Pnei Yehoshua has strengthened the link that Rashi makes between Matfis Temimim and Makdish Eved l'Damav.
