DAF DISCUSSIONS - GITIN 2

Moshe asked:

Scimming & noticed your pshat that 2 eidim who bring a get are beleived with a migo rather that aydus.

1. Why is it not a migu l'bei trei?

2. Why can it not be eidus?

They are not nogea, the aydus does not pertain to them (I seem to remember from chezkas habatim & Kidushin that many achronim hold that if it does not pertain to you there is no nogea, how would we explain accordin to them that they are not adim here)?

The Kollel replies:

1. The Chasam Sofer himself ends off that this explanation is problematic because it seems like it is a Migu l'Bei Trei (he says that it is possible to answer the question, but does not give an answer). This is indeed one of the reasons why Rav Elyashiv dismisses this explanation (see 5a).

2. In general, many questions are asked on this explanation by many Acharonim (i.e. see Otzar Mefarshei ha'Talmud 5a, note 47 where many questions are asked on this explanation). An extensive defense of the explanation is beyond the scope of this forum. Good questions.
