Why was the Tnai of Bnei Gad and Bnei Reuven not considered against the Torah commandment of Yishuv Eretz Yisrael?

The Kollel replies:

Masneh Al Mah she'Kasuv ba'Torah means that the Tenai involves a trangression of the Torah. In this case, the Tenai was that they fight to conquer Eretz Yisrael, which certainly is a fulfillment of Mitzvas Yishuv Eretz Yisrael.

Also, it is not at all clear that living across the Jordan is not Yishuv Eretz Yisrael. In Sotah 14a, Hash-m tells Moshe "I know you only want to reach Eretz Yisrael in order to fulfill the Mitzvos ha'Teluyos ba'Aretz." What about the Mitzvah of living there, in and of itself? This implies that he already could fulfill that Mitvah where he was.
