DAF DISCUSSIONS - NEDARIM 67

Benzi asks:

The Gemara says v'Iba'is Aima Havia Kidushin Mashma and the Ran says on this that since it's Mashma Kidushin therefore the father can't annul the neder so what I don't understand is that if the Ran takes on here that the father can't annul the neder then what is the next question of the Gemara that Aima Av Lechudeih Leifer but the ran just said that he can't annul it.

Benzi, London

The Kollel replies:

The Ran here on 67b (in the ninth, medium-wide line, "she'Im Hekim Hukam") explains this to mean that only the father can actually annul the Neder, but the husband does have some minimal power left -- namely, if he does not annul the Neder on the day that he hears it, this means that he has automatically approved of it, and then even the father cannot annul it. The Ran earlier did not actually say that the father cannot annul the Neder but what he said was that the father cannot annul the Neder on his own. We are now saying that if the husband is "Mekim" (approves of the Neder), then the father cannot annul it. The question of the Gemara that "Eima Av Lechudei Leifer" means that it is only the father who has the power to annul on his own, but if the husband annuls and the father is "Mekim," the annulment of the husband has no power.

All the best,
