DAF DISCUSSIONS - NEDARIM 67

In the Insights to Daf 67 the following statement was made:

"Similarly, from the phrase, "u'Nedarehah Alehah" alone we would not be able to learn that the Arus is Mefer b'Kodmin, because that phrase might be referring simply to the Nedarim that she made after she became betrothed."

Actually Why does the Gemara relate the psukim to Na'arah Meorasa? Rava says "Hoto Tihiye" is a hint at a second "Havayah" - why could this not be interpreted as marrige - Nissuin, and the first psukim deals with the case of Nedarehah Alehah - the vows made preceding Nissuin, abd the next psuikim refe to "Beit Ishah Nadara" - vows made while married. If this interpretation were used, we would have no specific source for a betrothed Na'ara, but since she is Bi'Neureha Beit Aviha - the father would do Hafara alone!

Of course - this interpretation is incorrect, since it is in cotradiction to the Halacha; but we could reconcile this interpretation with the Halacha as follows: Since we know that a betrothed woman is an Esheth Ish for all intents and purposes MiD'Oreissa, albeit with a different punishment for adultery, it does not stand to reason that the husband cannot annull his wife's vows, especially since they concern him, or concern his future wife. Lama li Kra, Svara Hi! Why should annullment be a distinction between the Arussa and the Nesuah? The reason is basically that the Arusa is still "Beit Aviha" - so the power of anullment is a joint power: the husband with the father.

Since the Tanaim did not say this it may be because there is something wrong with this Drush, but then we should find the mistake` Alternatively we could say "Adifa Minei Mishanei" - but then we would have to find why the drashot in the Gemara are indeed "Adifa"!

Havayah means Erusin.
